FSAR 4G01 • Forest Service Acquisition Regulation referred to as the FSAR. • The FSAR is not by itself a complete document, and must be used in conjunction with the Federal Acquisition Regulation (FAR) and Department of Agriculture Acquisition Regulation (AGAR).
4G01.608-1 General • Contracting Officers may designate qualified representatives to ensure that contracts are administered properly to meet mission needs. • The term Contracting Officer’s Representative (COR) is often used interchangeably with COTR. • Designation as a qualified COTR requires the certification of competencies in the area of contract administration. • These competencies do not reflect the technical or program-specific skills required of a COTR which may require additional technical certifications, such as the COR Engineering Program.
4G01.608-2 Applicability • All COTRs for procurement contracts must satisfy the appropriate COTR requirements in the Federal Acquisition Institute (FAI), Federal Acquisition Certification for Contracting Officer Technical Representatives (FAC-COTR), USDA Acquisition Workforce Training Delegations and Management System (AWT), and this subpart. These documents are available online at the FAI website and the Washington Office Acquisition website.
4G01.608-3 Responsibilities • Regional Foresters, Station Directors, Area Director, International Institute of Tropical Forestry Director, Job Corps Conservation Center Directors, Washington Office Staff Directors. These positions are responsible for ensuring an adequate pool of COTRs to administer their units’ contracts.
4G01.608-3 Responsibilities • Program Manager. According to the AWT direction, a Program Manager is defined as the person with the overall responsibility for program plans, budgets, schedules, and timely completion within cost limitations. A Program Manager’s responsibility for COTRs includes: • (1) Developing certified COTRs for their program’s procurement contracts. • (2) Ensuring that COTRs develop appropriate technical skills and program knowledge; and
4G01.608-3 Responsibilities • (3)Providing a list of certified COTRs to the CO for a specific contract and documenting the supporting evidence for selecting a COTR for a specific contract in writing, if requested.
4G01.608-3 Responsibilities • Supervisors of COTRs • (1) Developing training plans for COTRs • (2) Evaluating the COTR with respect to the competencies listed in the AWT direction. • (3) Determining the level of COTR • (4) Ensuring the COTR’s level of certification is documented and providing a copy to the COTR.
4G01.608-3 Responsibilities • COTR • (1) Maintaining documentation of all training • (2) Entering all required data into the Acquisition Career Management Information System (ACMIS). • (3) Designating employees as Inspector’s to aid in administering and monitoring a procurement contract. Designation as an Inspector does not enable the employee to act as a COTR.
4G01.608-4 Training • Level 1 (Basic) COTR, 40 hrs within 6 months, 40 CLPs every 2yrs. • Level 2 (Mid) COTR, 80 hrs within 3 months, 40 CLPs every 2yrs. • Level 3 (Advanced) COTR, 120 hours within 3 months, 40 CLPs every 2yrs.
4G01.608-5 Certification • (1) The program manager will submit a list of COTRs who meet the certification requirement. • (2) The CO will make the final determination on who will be appointed as the COTR. • (i) Only individuals satisfying the COTR Level I or higher requirements may be designated by the CO; • (ii) The CO may designate COTRs from other government agencies who meet the requirements the FAI FAC-COTR.
4G01.608-5 Certification • (3) The written designation of a COTR by a CO, delegates that individual limited authority for the administration of various technical aspects of a contract. • (i) The Forest Service Handbook 6309.11, Contract Administration Handbook, identifies many of the technical administration requirements and formats to be utilized by a COTR.
4G01.608-5 Certification • Proof of Certification. Designated COTRs must provide proof to the CO that they meet the requirements for the level of certification required. • (1) An ACMIS document illustrating the current training, OJT, and experience requirements is the preferred proof of certification. • (2) COTRs unable to produce an ACMIS document may submit a letter, signed by their supervisor, certifying the employee satisfies the requirements for certification at a specific COTR level.
