  1. Welcome to our Program! We are in business of helping home owners that are trapped in their mortgages. We help clients that owe more than their current property’s value. We help clients who can’t afford adjusting mortgage payments. We help clients that are current, in Notice of Default & in Notice of Sale.

  2. How we can help! We provide education and information to clients to advise them of their rights under Federal and State laws in regards to their mortgage situation. AllClients who have refinanced their primary residence in the last 3 years, have protection under these laws. Limited purchase and refinance transactions up to 4 years may also qualify for our program, Ask your “AFFL” consultant for details. We do a forensic audit of your original loan documents, using proprietary software. This audit exposes lender violations and shifts the power from the lender to the client.  We force the lender to work with us on your behalf. If necessary, we will initiate legal action against your lender.

  3. Possible Outcomes! We force the lender to recast the terms of your loan. We have success in lowering interest rates, payments and principle balance without a refinance. In some cases, your loan may be rescinded. This means your mortgage never happened. You can walk away from your house without any damage to your credit. The lender will be forced to reimburse allloan settlement monies paid by the borrower in regards to this loan. You might even own your property free and clear!

  4. Getting Started! Contact The Advocate to set up an appointment to speak to one of our consultants via phone at (626) 963-8705. Complete the Client Registration Packet. Get the Power of Attorney documentnotarized. This allows us to contact your lender, on your behalf, to demand your original loan documents and litigate if necessary.  Our “POA” is limited and does NOT allow any title transfers to take place! Submit the registration packet, power of attorney and first payment to The Advocate’s corporate office.

  5. Fee Structure! Our fee structure is a monthly payment  that is fair and equitable based on the borrowers ability to pay. Our client pays a discounted fee based on 70% of their pre-adjusted, NON- impounded, mortgage payment. For example, if a client was paying $2,000 (principle and interest only) per month and their loan adjusted to $3,200, we would calculate our fee based on 70% of the $2,000 (pre-adjusted) payment.  This would make their monthly payment to us  $1,400. We offer an affordable approach based on the value of service we provide. Our unique, one-of-a-kind product of forensic auditing and legal support  provides the client positive mortgage options and outcomes that are beneficial to them. *Maximum of 3 payments due to us.

  6. Fee Structure! The monthly fees paid are credited against the total fees that are demanded from the lender. The Advocate is entitled to 25% of the client’s benefit, which is demanded from the lender. For example, if client’s benefit is $100,000 in principle reduction, then AFFL will charge the lender $25,000. Additional legal fees may be incurred, which will also be demanded from the lender. If we do not find any violations upon completion of our discovery and audit, Advocate will reimburse all monies paid to Advocate by the Client.

  7. Timeline! Phase I * File is received at corporate* Input of Client information* First letter sent to lender demanding: * No derogatory credit reporting while in dispute * Contact the Advocate, not the borrower * All client original documents pertaining to this loan Phase II *If lender cooperates, and Loan documents are received at corporate within the allotted 20 day period, then the audit is completed and borrower will be notified by “AFFL” to set up an appointment. *If the lender refuses to send us the documents, then we must place a demand to the courts , to subpoena the documents.  *Client will be scheduled with legal no later than 45-60 days into the process. (Phase 1 and 2 take approximately 30-60 days to complete, depending on lender cooperation)

  8. Timeline continued… Phase III *Legal demand is created by “AFFL” , authorized and signed by client,  then sent to lender. *If lender accepts demand, then settlement is completed. *If lender doesn’t accept demand, then court action is initiated. *Depending on lender cooperation, this Phase is approximately 30-90 days.

  9. Additional Information! Although we can’t make guarantees that your credit will not be affected while in this process, we will go after the lender to remove any credit derogatory reported. We look to the lender to reimburse all fees paid by you for our services. We request the client to provide any and ALL documents relating to their loan transaction.  

  10. Additional Information continued… This includes and is not limited to : *Mortgage coupons (for all loans that qualify for our program) *Truth-in-Lending disclosure document *Final HUD-1 and or Final settlement statement *Note *NOD/NOS notices (If applicable)  *Even though we demand original documents from the lender, due to possible lender delays, we can do an initial audit with client’s copies.

  11. Additional Information continued… • In the instances of “Notice of Default” and or “Notice of Trustee Sale”, We need a minimum of 20 calendar days before trustee sale date to perform our due diligence. In these “rush” situations, client MUST submit their loan documents to “AFFL”. • Any loan type qualifies for our program;  30 yr fixed, adjustable rate mortgages, negatively amortized loans, interest only loans, etc… AS long as the refinance was done in the past 3 years as a primary residence (limited purchases/refi’s up to 4 years are ok. Ask your “AFFL” consultant for details). • *Home equity loans (HELOCS) do not qualify for our program. • We look forward to offering you positive options for your mortgage situation.
