Section 6(1) Every person working under the Mahatma Gandhi NREGA is entitled to wages at the wage rate notified by the Central Government.
Section 3(3) Workers are entitled to being paid on a weekly basis, and in any case within a fortnight of the date on which work was done.
Paragraph 30, Schedule II Workers are entitled to compensation as per the provisions of the Payment of Wages Act, 1936. In event of any delay in wage payments, compensation costs have to be borne by respective State Government. In case wages are paid beyond 15 days of work done, compensation as calculated under provisions of Payment of Wages Act, 1936 shall be paid along with wages without the worker having to file a claim for compensation.
Paragraph 8.8 (v) of the Mahatma Gandhi NREGA Operational Guideline, 2013 Recommends that “action under section 25 of the Act be taken against agencies / officials responsible for causing the delay. Further, compensation required to be paid to the workers shall be recovered from the agency / official responsible for the delay.”
