CONSUMER PROTECTION AND COMPETITION HIGHLIGHTS • Consumer Protection Act (CPA) has been in existence for fifteen (15) years • The CPA is being administered by Department of Trade and Consumer Affairs under the Ministry of Trade and Industry
PROVISION OF THE ACT The Act provides for the protection of the interests of consumers by means: • investigation; • Prohibition; • control of unfair business practice; • disseminate consumer-related information; • provide for matters connected with and incidental to the forgoing.
REVIEW OF THE CPA CPA is being reviewed to match the international best practices; the new issues to be introduced include • Introduction of the National Consumer Tribunal • Enhance functions of the office • Accreditation of Consumer Organizations • Industry Code of Conduct
EXAMPLES OF CASES/ HOT TOPICS FACED BY THE OFFICE • Misleading advertising particularly on shelf price vs. till price • Selling of expired/tainted food products • No warrantee on imported vehicles • Selling of poor merchantable cellphones • Garages failing to repair customer vehicles • Selling of electronics with no guarantees • Limiting guarantee on cellphones • Due to lack of Type Approval of cellphones, we get all sorts of cellphones being sold in the country
Cross border Issues • The Act doesn’t provide for cross border cases • Botswana is signatory to declaration on regional cooperation on Competition and Consumer laws and policies
