  2. Energy Policy Act of 2005 • Section 313- grants significant new federal authority. • ---the Rational Siting Process • Lead agencyfor coordinating all Federal authorizations and for complying with NEPA.

  3. Authorities Given to FERCLNG • Pre-Filing Regulations effective November 17, 2005 • Mandatory use of PRE-FILING for LNG applicants • Exclusive siting authority

  4. Pre-Filing Requirementsfor LNG Projects • Meet with staff regarding proposed project • Submit draft RFP for 3rd Party EIS contract and draft PF request for staff review • File PF request • Complete at least 6 months of PF review

  5. Contents of PFRequest Letter • Anticipated schedule for filing of application and desired date for Commission approval • Description of zoning and site availability • Description of the project area including maps and plot plans • List of federal and state permitting agencies agreeing to participate in PF

  6. Contents of PFRequest Letter • Dates for submission of required permit applications • Description of work done to date (e.g., surveys, stakeholder contacts, engineering) • List of interested persons and organizations contacted • Proposals from 3rd party contractors

  7. Contents of PFRequest Letter • Identification of environmental and engineering firms under contract • Agreement to submit COMPLETE Environmental Report and application • Public participation plan • Certification that LOI and prelim. WSA have been submitted to USCG

  14. FERC Coordination with States– LNG Only • Governor appoints an agency to consult -ME,NY,NJ,DE,MD,MS,LA,TX,CA,OR- • FERC must consult with this agency • State agency may file a safety advisory report

FERC Pipeline and LNG Projects in NEPA Pre-Filing FY 2006 • CenterPoint Energy Gas Transmission: Carthage to Perryville Project, 42”, 170-mi. pipeline from Carthage, Tx –Delhi, La. 20,620 HP • Transcontinental Gas Pipeline: Potomac Expansion Project, 2, 42”, 20 mi. pipeline loops, compression upgrade in Va. • Rockies Express Pipeline: Rockies Express Project, Segment 1, 42", 710 mi pipeline from Cheyenne Hub to Audrain Co., Mo., 1.5 Bcf/d with 4 compressor stations. • Transwestern Pipeline Company: Phoenix Expansion Project, 36", 260 mi. pipeline loop and compressor replacement from Yavapai Co. to Phoenix, Az. • Algonquin Gas Transmission, LLC: Ramapo Expansion Project, replace 4.8 mi. of 26" with 42" and compressor upgrades in NY, Ct., & NJ. • Iroquois Gas Transmission System, L.P.: Market Access Project, compressor station & cooling facilities in Ct. & cooling facilities in NY to accommodate additional volumes by Millennium and Algonquin. • Northern Natural Gas Company: Northern Lights Project, 109 mi. various dia.
