Employer’s Responsibilities • Workplace Safety and Health Program must include: • Statement of procedures to be followed when a contractor is involved in work at the workplace that includes: • Criteria for evaluating and selecting contractors • Procedures for monitoring contractors
Other Considerations Is the contractor competent in undertaking the work to be performed? (Tickets, CSA, COR, ISNet World, ect…) Is the contractor introducing additional hazards or controlled chemicals into my workplace? Are they bonded and carry general liability insurance? Are they in good standing with WCB?
Good standing with WCB? • Employers have two responsibilities relating to WCB coverage when hiring contractors: • Provide WCB coverage for sub-contractors who do not qualify for their own WCB coverage • non-covered industry • self-employed (no workers) • Ensure qualifying contractors and any workers they employ are registered, and in good standing with the WCB
WCBIs the injured person a worker? • Worker (broad definition) – subsection 1(1) WCB Act • Learners • Casual Workers • Emergency Workers • Deemed Workers • Domestic Service Sitter/Companion for child or aged, infirm or ill member of the household (24hrs/week)
Contractors and the Workplace • Do we have a contractor policy? • Are we checking contractors for • WCB clearances? • www.wcb.mb.ca/clearances • Are contractors going through an orientation? • How do we track contractors on site?
Clearance System - Status • Good Standing – company has coverage • Deemed Worker – registered with WCB do not have appropriate coverage for a general contractor and are deem workers of the contractor hiring them • Deemed/Default Worker – not in good standing with WCB, once complied they become deemed workers • In Default – registered but account due • No Account – not registered
Clarifying Points • If contractor doesn’t have coverage and is injured performing work on your jobsite, the contractor may be deemed a worker of your company • Clearances are not required for companies that supply material only • You are not allowed to deduct earnings to your deemed worker to offset any financial obligation to WCB
