  3. What is the Utah Water Use Program? • Cooperative effort • Collects and compiles water use and diversion data • Water resource studies and water management policy development • Water supply system characteristics, total water diverted and placed to beneficial use

  4. How is information gathered for the Utah Water Use Program? • Annual survey conducted by the Division of Water Rights • Data form is mailed or e-mailed in the first week of January • Monthly diversions from each source operated • Purpose for which water was used during the previous calendar year • Reminder notice and paper form sent to all non-responders in early March

  5. Mandatory or Voluntary? • Mandatory if: • Required by an Order of the State Engineer • Condition of water right approval • Requested by the State Engineer • To obtain State loans • State Statute and Rules suggest reporting is mandatory. Sec. 73-5-8 UC and Rule R309-102-8.

  6. Nonuse and Forfeiture • Nonuse Period increased from 5 to 7 years • Public Water Supplier • Reasonable future water requirements of the Public • Water rights acquired after May 5, 2008
