National Commission Duties • Promulgate rules and operating procedures • Equitably distribute costs, benefits and obligations of the Compact among the member states • Monitor compliance and initiate interventions to address and correct noncompliance • Facilitate dispute resolution • Coordinate training and education • Collect and disseminate information concerning the activities of the Compact Serving Juveniles While Protecting Communities

Purpose of a State Council • The state council’s responsibilities may include: • Oversight and advocacy • Develop policy concerning operations and procedures of the compact • The structure of the State Council is designed to: • Provide a mechanism for empowerment of the Compact process • Assist in developing Compact policy • Determine qualifications for Council membership • Appoint a designee in a Commissioner’s absence Serving Juveniles While Protecting Communities

Executive Committee • Serves as: • Oversight committee for Compact operations • Without power to amend rules or the Compact • Board of Trustees to the National Office • Areas of responsibility include: • Financial management, compliance enforcement, staff appointments and retention, physical infrastructure, strategic planning and scheduling Commission meetings Serving Juveniles While Protecting Communities

Officers • Chairperson • Call and presides at Commission and Executive meetings • Makes appointments to all Committees • Acts on Commission’s behalf • Vice Chairperson • In absence of Chairperson, performs their duties • Treasurer • Custodian of funds and monitors administration of fiscal policies and procedures with the Executive Director • Immediate Past-Chairperson • Provides continuity and leadership Serving Juveniles While Protecting Communities

  11. Regional Representatives • Elected bi-annually by a majority vote of each region • Responsible for assisting new Commissioners/Designees in their region • Serve as nominating committee for election of Officers • Chair Region Meetings Serving Juveniles While Protecting Communities

Commission Roles • Commissioner: • Appointed by the appropriate authority (Governor or State Council) • Acts on behalf of and represents the state on the Commission • Designee: • Acts on behalf of the Commissioner • Deputy Compact Administrator • Responsible for the administration and management of ICJ Serving Juveniles While Protecting Communities

Commissioner/Designee Ensures… • Compact mission and purposes are promoted • Appointment is compliant with Statute • State Council is functioning • Dues are paid • Compact Office has adequate resources • Develop and maintain working relationships with: • National Office • Judiciary • State Council Members • Other Commissioners • Compact Office & DCA Serving Juveniles While Protecting Communities

  16. Commissioner/Designee Ensures… • Participating in all Commission meetings • Participating and providing training on the management of ICJ • Coordinate the implementation of Rules • Informal disputes are handled Serving Juveniles While Protecting Communities

Organizing the Compact Office • Some things to consider: • Is there adequate staffing? • Does the office have the resources it needs to effectively carry out its duties? • Are processes in place to ensure compliance? • Is information being provided in a timely manner? • Have all compact staff received training?   18. Commissioner/DCA Relationship The relationship between Commissioners and DCA(s) in each state should be reciprocal. With the assistance from the DCA(s), Commissioners should be aware of the following: • Daily Compact Office operations I • How JIDS affects field operations, and what can be done to assist local operations • What type of support the DCA needs to address problems with field offices • How the Commissioner can assist the DCA if the Compact Office is not recognized as the Compact authority Serving Juveniles While Protecting Communities

Compliance Committee • Monitor State’s Compliance • Develop Enforcement Procedures • Draft & propose policy • Initiate interventions to address and correct non-compliance • Recommend penalties for defaulting states • Fines • Remedial training and technical assistance • Suspension and termination of membership in the Compact • Handle Formal and Informal Disputes Serving Juveniles While Protecting Communities

  22. Finance Committee • The ICJ Treasurer acts as custodian of all Commission funds • The Finance Committee monitors the budget and administration of all fiscal policies Serving Juveniles While Protecting Communities

  23. ICJ Budget • Fiscal year is July 1- June 30 • The Finance Committee recommends for approval the budget presented by the Executive Director • The Finance Chair presents the budget to the Commission at the annual business meeting Serving Juveniles While Protecting Communities

  24. Finance Reports • The Executive Director submits monthly financial reports to the Finance and Executive Committees • The Commission is audited each year • The Council of State Government performs all accounting functions for the Commission Serving Juveniles While Protecting Communities

Adoption of Rules • Submit to Commission for consideration “not later than the next annual meeting falling in an odd-numberedyear” • Publish text and notice of public hearing, not later than 30 days prior to scheduled vote • Commission takes final action on the proposal by a majority vote of yes/no Serving Juveniles While Protecting Communities
