Background By signing PRTR protocol Ukraine has taken obligations on creation of informational system of PRTR. By this protocol 86 substances are defined, among which - green house gasses, substances which destroy Ozone layer, heavy metals and POPs.
Agreements 1. The Aarhus Convention signed (1998) and ratified by Ukraine (1999) 2. Stockholm Convention on Persistent Organic Pollutants (POPs) ratified by Ukraine (2007) 3. The protocol “Pollutant Release and Transfer Register (PRTR) was signed by Ukraine in Kiev ( 21 May 2003) but still not ratified.
Latest events: • Second session of the International Conference on Chemicals Management (ICCM-2), held in Geneva from 11-15 May 2009 ICCM - high-level international forum for multi-stakeholder and multi-sectoral discussion and exchange of experience on chemicals management issues • High – level segment fourth meeting of the Conference of the Parties of the Stockholm Convention on Persistent Organic Pollutants (Geneva, 7-8 May 2009) Results: Directions to create Center for implementation in Ukraine of Basel, Rotterdam, Stockholm Conventions
Actions • Steps which Ukraine fulfils concerning implementation of Aarhus Convention and its protocols. • Adopted Action Plan concerning implementation Aarhus Convention in Ukraine • Took participation in activities of AC and removal of warnings from Ukraine. • Regular meetings concerning AC at the Ministry with other shareholders: Ministries, NGO • Willingness of taking active participation in implementation of the global project and development of pilot system of PRTR in selected region of Ukraine. • 9 Ministries of Ukraine are working now on questions concerning ratification of the Protocol • Consultations with NGO
Potential obstacles and barriers for implementation of PRTR • Contradiction in normative-legal acts. • Absence of normative base concerning settlement of payment of informational service. • Absence of informational structural subdivisions and its insufficient provision of stuff. • Creation of PRTR in Ukraine is not an easy task. First of all because of lack of experience. Joining to the Protocol will mean the willingness to open access to the public for any information concerning PRTR. But for achieving this goal, financial assistance from international organizations is needed.
Legislative considerations For collection and analysis of ecological information and for informing of the public, a number of documents were adopted: • Resolution of Verhovna Rada (Parliament) of Ukraine # 2169-IV “Information of the public concerning environment protection”. • Act of Prime Minister of Ukraine # 51333/1/1-04 “Information four times a year the public concerning the most pollutant materials” • Provision “The main information about the Environmental Discharge is monitoring of environment”
Benefit of PRTR • Creation of national PRTR in accordance with the Protocol of Aarhus Convention will simplify gathering of POPs information, which is needed for preparation of National Environment Report, for example. • Majority of Ukraine’s regions are willing to participate in development of pilot system of PRTR. This activity is coordinated by the Ministry of environment Protection of Ukraine.
