  2. Outlook for Reauthorization Current Extension Expires March 31, 2012 Existing Highway Trust Fund only supports $230 billion over 6-years or $76 billion for 2 years Current annual levels are $52 billion - $41.1billion for highways, $10.5 billion for transit & $1.3 billion for safety

  3. Outlook for Reauthorization - House House 6-year bill – current levels of investment - $320 billion Chairman Mica looking for $90 billion or $15 billion per year – may need to be part of the Super Committee recommendations Time frame is early 2012 – this is post Super Committee action

  4. Outlook for Reauthorization - Senate Senate 2-year bill – current levels plus inflation Need to find $12-13 billion to supplement Highway Trust Fund revenues Why 2-years - they think they can find revenue and get GOP support Nov. 9 mark-up in EPW, nothing in Finance at this time Shooting for action in 2011

Outlook for Reauthorization – Both Bills Similar Policy Consolidate current programs Accelerate project delivery Leverage private sector resources Prioritize National Highway System Increase state flexibility & reduce programmatic set-asides Establish performance standards No tolling existing Interstate No new freight program No earmarks

  6. 3% Withholding Repeal Current law requires governments at all levels to withhold 3% of payments from contractors beginning on Jan. 1, 2013 (2005 Tax Bill) House has voted 405-16 to repeal Senate ??

  7. TDOT Proposed Budget FY 12-13 - $1.712 Billion - $802,500,000 – State Funds - $876,972,900 – Federal Funds - $41,214,000 – Other Funds $105 Million less than FY 11-12 - $27 million less federal money - $78 million less state money – most of which is the bridge bond money

  8. TDOT 2011 Program Approximately $900 Million in Project Awards No New State Funding Uncertainty at the Federal Level

  9. TDOT DBE Goal–FY 12-14 Overall Goal of 7.35% - 6.24% - Race Conscious - 1.11% - Race Neutral TDOT must include a small business element to the program to facilitate participation by small businesses generally, not just DBEs - Must be submitted to FHWA by Feb. 28, 2012

  10. TN General Assembly Redistricting is Current Major Focus - House - Senate - Congress

Limited Liability Accident in WZ and a driver is DUI then TDOT/contractor/consultant not liable unless there is negligence If a contractor builds according to TDOT Specification or consultant designs according to TDOT design standards, then not liable for suits claiming injuries on a project – under construction or completed

TN Lawful Employment Act - E-Verify Not required to use E-Verify (can ask for a copy of a drivers license) but do not have a safe harbor Must also check independent contractors Effective Jan. 1, 2012 for employers with 500 or more employees; July 1, 2012 for employers with 200-499; Jan. 1, 2013 for employers with 6-199 employees

  13. Corporate Campaign Contributions Effective June 1, 2011 Contribute to PACs without reporting Contribute $250 or more to individual candidates must report just like a PAC If want to give corporately to individual candidates strongly suggest setting up a PAC
