FNPO CLASSIFICATION CONTROL AND APPEAL RULES

Appointing Authority Government Servants classified into four groups – Rule 6 of CCS(CCA) Rules 1965
Disciplinary Authority Empowered to award minor penalty Higher disciplinary authority empowered to award minor/major penalties
Appellate Authority Authority designated to consider and decide on the appeal The Authority is listed in the schedule to the CCS(CCA) Rules for each cadre/Post
Memo of Charge For Minor penalty memo of charge under Rule 16 of CCS (CCA) Rules is to be issued by the Competent Authority For Major penalty memo of charge under Rule 14 of CCS (CCA) Rules is to be issued by the Competent Authority
Disciplinary Proceedings For Minor Penalty – Rule 16 Charge Sheet with statement of imputation of misconduct or mis-behaviour. 2. For Major penalty – Rule 14 Charge Sheet. It shall have four annexure.
Documents Statements, other official records which are listed in the annexure III of the charge sheet are called documents
Conduct of inquiry under Rule- 14 Issue of Charge Sheet Appointment of IO and PO Oral inquiry
Introduction of documents Examination of witnesses Cross examinations Re-examination of witnesses Re-cross examinations Defence witnesses if any PO brief – Representation by charged official IO report – Representation by charged official Oral Inquiry
If aggrieved – Charged Government Servant may submit appeal to the appellate authority Final order by disciplinary Authority
