  20. Virginia Fun Facts Virginia is an employment-at-will state.An employee may be terminated at any time, for any reason or no reason. Exceptions: discrimination, OSHA Employee breaks are not required, unless the employee is under the age of 16 years old. There is no restriction on the number of hours worked as long as the employee is 16 or older. Virginia legislation does not address drug testing in private employment – employers can require or ask employees / applicants to take a drug test.
