Burden of Proof Beyond a reasonable doubt vs. Preponderance of evidence vs. Clear and convincing
Case #1 Dr. Edwina Weathersly is a notorious overutilizer, just never caught. The Neverpaysontime Insurance Company sent in a complaint that the doctor will not send records. Your investigator finds billing records, but no medical records at all on at least 20 patients.
Case #2 Dr. Don Liewersky and his faithful office manager Jules Finnergan were caught having an unlicensed chiropractor doing histories and physicals in their office. When confronted, they said, “we have been doing this for years, what’s the big deal as long as we don’t let them actually adjust anybody?”
Case #3 Dr. Smitty Oliver Buds’ ex-girlfriend Mona registered a complaint to your board after they broke up. It seems that they started dating after she came in a few times and started billing her insurance company for endless undocumented appointments to help pay for their lavish vacations in Buddy Holly’s home town, Lubbock, Texas.
Case #4 Dear Licensing Board, I will be released from the Breakinrocks Penitentiary next month. I have maintained my continuing education credits through classes offered here and have kept up my adjusting skills with a thriving practice in the prison infirmary. May I apply for a license in your state. Sincerely, Dr. Dan Saint Bernard
Case #5 Dr. Cole Willen was finally nailed by your board for an insurance fraud scheme lasting 5 years. The Feds step in, claim jurisdiction and prosecute him first. He is indicted in federal court and Judge Dredd instructs Dr. Willen to voluntarily surrender his chiropractic license.
