Compacting • Send letter of intent to BIA for either planning or negotiating. • Decide which programs and services. • Research how the funding will be allocated • Determine tribal share. • Set up internal monitoring and budgeting processes.
Kaw Nation Negotiation Team • The Kaw Nation Negotiation Team is composed of the Self-Governance Department, Compact Attorney and the Executive Council. • The Federal Team is composed of OSG, BIA Regional Finance, and OST.
Preparing For Funding Agreement Negotiations • The Self-Governance Department begins in March-April preparing for negotiations. BIA negotiations begins in June or July. • During the Annual Self-Governance Conference, tribes nationwide discuss issues that may arise in the following years negotiations, i.e. language, regulations. • Tribes should review the negotiations guidance, current Funding Agreement and BIA policies for any changes or new issues that would pertain to the Nation for the following year. • Tribes may include Roads funding in their Funding Agreements.
Draft Funding Agreement • The Self-Governance Department begins making revisions to the current FA and tables, consults with the Compact attorney and other key employees in June. • Compare the current funding tables. • Consult BIA Compact Directors if necessary.
Send draft FA to Compact Attorney for further review and legal language. Send to CEO for approval. Draft is then forwarded on to the BIA for their review. Continue Draft Funding Agreement
Negotiations • As soon as the draft FA is sent the Negotiation Team will begin negotiating with BIA. • The team will meet face-to-face to discuss any changes and issues to try and resolve them. Face-to-face negotiations may not always be necessary. • Negotiations may continue after the first meeting with conference calls, faxes and e-mails.
Final Negotiations Packets • Two signed compacts (for new SG Tribes) • Two signed, original funding agreements • Two signed, original funding agreement reprogramming requests worksheets • Two copies of authorizing Tribal resolution, as needed • Two copies of attachments (MOUs, Memorialization of Matters Remaining in Disputes, footnotes, Indian Reservation Roads Addendum)
