  10. BLOWN AWAY PART OF THE PIPELINE: EXAMPLE OF THIRD PARTY DAMAGE

  11. THIRD PARTY DAMAGE TO PIPELINE: ANALYSIS BY PROF. DE MEESTER (UCL) Damage probably caused by ground compacter

  12. Fluxys in a nutshell Ghislenghien accident Prevention of third party damage • Legal provisions

  13. THIRD PARTY DAMAGE: MAIN CAUSE OF PIPELINE INCIDENTS • Most frequently occurring cause of damage • Single cause with pipeline rupture as possible consequence : • most serious damage possible • occurs however only exceptionally • Fluxys: prevention policy with awareness raising campaigns towards all parties involved Prevention of damage by third parties is the joint task of all parties involved: Fluxys, municipalities, contractors, owners and operators

  14. LEGAL BASIS: ARTICLE 11 GAS ACT 1965 “The partial occupation of public or private property shall respect the use to which it is put. It shall not lead to any dispossession, but constitutes a legal easement of public utility which prohibits any act which could damage the gas transportation facilities or their operation. (...)"

  18. Fluxys in a nutshell Ghislenghien accident Prevention of third party damage • Legal provisions • Fluxys prevention policy

  19. Fluxys: • Involved – not involved • Location plans • Safety regulations Before start of works: legal duty to report FLUXYS: TRANSPARENT COMMUNICATION TO ALL PARTIES INVOLVED

  20. Pipeline in the vicinity? Yes No • REPLY WITHIN 15 WORKING DAYS: • Letter • Indicative location plans • Safety precautions to be undertaken REPLY LETTER WITHIN 3 WORKING DAYS FLUXYS ANSWERS TO ALL REQUESTS REGARDING INFRASTRUCTURE IN THE VICINITY ON AVERAGE 300 REQUESTS PER DAY If a reply is not received quickly the works are likely located in the vicinity of natural gas transport infrastructure

  21. Fluxys: • Involved - not involved • Location plans • Safety regulations Before start of works: legal duty to report Legal duty to reportat least 8 days prior to start of works Supervision by Fluxys Fluxys: Setting out markers on site FLUXYS: TRANSPARENT COMMUNICATION TO ALL PARTIES INVOLVED

  22. Fluxys patrols • Mainly tracing unreported works • During works: laying free additional markers of the pipeline at the request of the contractors with an explanation of the safety regulations

  23. Fluxys: • Involved - not involved • Location plans • Safety regulations Fluxys:Awareness raising campaigns Target group: Before start of works: legal duty to report • Municipalities • Contractors • Owners • Notaries Legal duty to reportat least 8 days prior to start of works Supervision of Fluxys Fluxys: Setting out markers on site FLUXYS: TRANSPARENT COMMUNICATION TO ALL PARTIES INVOLVED

  24. Fluxys visits each municipality every 5 to 6 years

  25. Fluxys-infrastructure in the territory of Winksele • Every 5 years Fluxys sends pipeline location maps (scale 1/10.000) to the municipalities involved • If the Fluxys maps (scale 1/10.000) are updated: the municipalities involved automatically receive an update

  26. Regular Fluxysmailings to owners, operators, contractors and notaries

  27. AWARENESS RAISING CAMPAIGNS: SUCCESS Information requests/year 70000 60000 50000 40000 30000 20000 Pipelines in the vicinity of planned works: number of information requests to Fluxys is steadily increasing 10000 0 2000 2001 2002 2003 2004 2005

  28. Fluxys in a nutshell Ghislenghien accident Prevention of third party damage • Legal provisions • Fluxys prevention policy • Follow-up post Ghislenghien

  29. REINFORCEMENT OF AWARENESS RAISING AND INFORMATION POLICY To contractors: awareness raising days in cooperation with the construction sector federations To municipalities: extra information sessions in cooperation with governors Together with other transporters per pipeline: central cartographic database of transport pipelines To the emergency services: specific actions in consultation with Federal Government Department of Home Affairs Strengthen the acceptance of infrastructure and realise new projects in the spirit of good neighbourness

  30. EXTRA INFORMATION SESSIONS FOR MUNICIPALITIES IN 2005: ‘TOGETHER FOR SAFETY’ • In cooperation with the provincial governors • Invited per municipality: mayor, secretary, head of Technical Department • 70% of municipalities with Fluxyspipelines present • Other 30%: special action in 2006

  31. CABLE & PIPELINE INFORMATION CHECKPOINT (CPIC) CPIC List of operators of underground infrastructuresinvolved Reporting works Reporting works Principal / Architect Contractor Operators of underground infrastructures involved • No infra in the direct vicinity or • Infra in direct vicinity: location plans and instructions

  32. Reporting works

  33. FURTHER DEVELOPMENT OF CPIC • First phase Q1 2006: high voltage connections and pipelines carrying gaseous & other substances • Next steps: to be developed into portal site to report works to all operators with underground infrastructure • Legal recognition of CPIC as a channel to fulfill duty to report Role of municipalities is evolving: in the long run their mission of first point of contact is to disappear

  34. Fluxys in a nutshell Ghislenghien accident Prevention of third party damage Together for safety: way forward

  35. TOGETHER FOR SAFETY: WAY FORWARD • Current legislation provides for ample safety prescriptions • Challenge: make sure that all parties concerned comply with legislation • Way forward: • Make legal duty to report works as less an administrative hurdle as possible • But: personal contact on site between pipeline operator and contractor remains crucial
