EPCRA – Facility Responsibilities Submit Planning Notification if an Extremely Hazardous Substance (EHS) is or was present at the facility at or above the Threshold Planning Quantity (TPQ) Facilities must promptly supply the LEPC with information requested that is necessary to complete an off-site plan. Submit annual Tier Two Chemical Inventory Report by March 1st to WEM, LEPC, and local Fire Dept. Must submit a chemical list or MSDS within 90 days to WEM, LEPC and local Fire Dept. Pay Wisconsin fees Range: $205 - $1,540 per year for Tier 2 One time planning fee of $1,080 Late fees
EPCRA – LEPC Responsibilities Complete Annual Plan of Work Requirements to receive grant funding Combined plan of work with EMPG Planning Annually update EPCRA County-Wide/Strategic Plan Develop new and update existing offsite facility plans (must be updated every 4 years) Insure implementation of local emergency response plan in the event of a spill or release Exercising 4 year cycle requiring 1 tabletop and 1 functional or full scale Administrative
EPCRA – WEM Responsibilities Administer the program state-wide Maintain state-wide EPCRA database of facility records Process/verify fee payments Compliance EPCRA grants to counties/LEPC’s Establish policy and guidance Outreach EPCRA planning policy and guidance
Off-Site Emergency Response Plan • Facility Description, Floor Plan and Pertinent Site Diagram. • EHS Chemicals Identified • Vulnerability Zone • Special Facilities Affected • Other Special Considerations • Transportation Information regarding routes where EHSs are typically transported

New EPCRA Web-based Paperless System • Rollout planned for January 1, 2011 • Facilities will submit on-line • All plans will be available on-line • Secure access 24/7 • Cost will be $535,100
Potential Role of WEM in a Clearinghouse • Collect voluntary data on nanotechnology use in the state • Assist businesses, although this will require trained staff • Develop a nanotechnology module for EPCRA’s new web-based paperless system • Modify Tier Two form to Tier Nano form
Potential Role of WEM in a Clearinghouse (cont.) • Develop planning guidance for nanotechnology • Serve as information conduit to fire departments and LEPCs • Provide training to first responders
First Responders Training • Need to know hazards on the scene • Develop training on nanotechnology to first responders • Including the associated risks
Resources Needed for Clearinghouse • Customized “Nano” module to EPCRA web-based paperless system • Support staff: • Number of staff depends on number of facilities • What will be tracked • The level of technical expertise • The amount of training and support provided to facilities and LEPCs • Costs to manage the program could be generated through Facility Fees (similar to EPCRA)
