Dear Paul, I haveinterviewed a number of witnessesforthe iza Mellowassault case. First, I spoke to thevictim´sfriend, Sandra Beacon. Sheclearly has competence to testifyas a lay witness. She can communicate in meaningfulway and understandssheisobligated to tellthetruth. However, much of whatshe has to sayishearsay. Itappearssheonlymetthesuspect once. As a result, much of heropinion of him comes fromwhatthevictimtoldherabouthim.
Thereis, of course, thepossibilitythatshewillembellishormisinterpretthevictim´sword. Theonlywitnesswho has firsthandknowledge and can give a recitation of factis Ms Mellow´sneighbor, Martin Aguilar. Mr Aguilar heardscreams at the time of thecrime and sawthesuspectrunningfrom Ms Mellow´sapartmentafterward.
I alsospoke to Doctor Helen Woods whoisprepared to testify as anexpertwitness. She has testified in courtbefore. Unfortunatelyhertesimonywasstricken off the record as itwasconsidered to be beyondthescope of expertise. However, this case isfar more straightforward, and weshouldnotencounterthesameproblem.
