What is “ocean zoning”? • A continuation of the “ocean enclosure movement”? • Division of a jurisdiction into uniform-use zones in keeping with the character of the physical environment (“highest and best use” • Interest groups receive collective “rights” • A change from multiple-use management
Why are we talking about ocean zoning? • USCOP, POC? • Perceived conflict/actual conflict • Perceived failure of multiple-use • Science on marine reserves • Enforcement issues • Interest-group unrest • California, Mass., EO on MPAs
What would it look like? • Ad hoc v. comprehensive • What kinds of zones? • Size of zones • Location of zones • Variances, etc.?
Does the LOS (assuming ratification) limit U.S. options? • Probably not (broad Art. 61 power) • Must allow navigation, cable, etc.
What about zoning the high seas? • Proposals have been made in the past • Shipping lanes, etc. • Navigating or fishing? • Reserves not well suited to HMS
