  3. Background Prior to 2012: • Board relied on self-reporting of criminal arrest by licensee’s during annual renewal process • Reporting by Law Enforcement Agencies • On-line complaints • Media

  4. NCGS 90-16(j) All persons licensed under this Article shall self- report to the Board within 30 days of arrest or indictment any of the following: • (1)        Any felony arrest or indictment. • (2)        Any arrest for driving while impaired or driving under the influence. • (3)        Any arrest or indictment for the possession, use, or sale of any controlled substance.

  5. Problems that bring physicians to the attention of the Medical Board

  6. Five Problem Areas • Alcohol/substance abuse/dependence and mental illness issues • Quality of care issues including inappropriate and/or excessive prescribing • Behavioral issues, including boundary violations, disruptive behavior and criminal arrests • Communication • Administrative issues (Required reporting)

  7. Case - 1 Substance abuse-Drug Diversion • Greensboro PD/High Point PD referral on Nurse Practitioner (NP) • NP prescribed controlled substance to non-patient for Oxycodone in exchange for cocaine • Criminal arrest in Guilford Co. PWISD Opiates; Conspiracy to OCSBF- Convicted (2/2014) • Board Action: MD’s license was suspended indefinitely (3/2015)Joint Committee-NCBON

  8. Case - 2 • May 2016 Arrest of Richmond County MD on charges of Sell & Deliver of Sch. II and IV Controlled Drugs Three Counts of Sexual Battery of patient • Rockingham SO and NCSBI Joint Investigation • Voluntary Surrender of MD License May-2016 • Criminal Charges pending Richmond County Court

Case-3 Heath Care Fraud/Standard of Care/Felony Arrest • Charlotte MD charged by DHHS/OIG/IRS with multiple federal felonies • MD failed to record adequate information in medical records to support certain surgical procedures for which MD billed • NCMB had evidence MD departed from the standard of care with diagnosis and surgical judgment of a patient. Charlotte MD Case • Suspension of MD license for 1 year in 2013 • Federal arrest- Multiple Heath Care Fraud Charges & Tax Evasion (June 2014) • Public Board Consent Order for Indefinite Suspension of Medical License (5/2015) • MD sentenced in Federal Court- 18 months active with $1M plus fine 9/2015

  11. Case- 4 • November2015 Arrest of MD by Moore Co. SO and NCSBI 6 Felony counts of OBCSF ; 4 Felony counts of Conspiracy to OCBF and 2 felony counts of insurance fraud • Prior NCMB Reprimand (June-2015) Unprofessional Conduct Self-prescribing to himself and family member (Sch.IV) • Criminal charges pending court in Moore County

  12. Case- 5 • Joint Investigation (Pitt Co. S/O, VA-OIG, NCMB) involving MD at VA Center in Greenville, NC • Authorizing C-II, C-III, and C-IV substances by MD to patient in an inappropriate relationship, resulting in felony charges by Pitt Co S/O • MD criminally charged 3/2015 for 7 counts of Felony OCSBF, along with patient. Pled guilty to 1 felony count w/1 year probation (deferred for 1 year) • Public Consent Order Jan/2016- Indefinite Suspension of Medical License

  13. US ISS LLC • Contract Vendor for 24 hour monitoring of Administrative Office of Court arrest data in NC • Direct report to NCMB for all criminal arrest in NC • 2015 New Case Source: 64 Cases • 2016 New Case Source: 42 as of 10/11/2016 • * Since 2012- 308 Board Cases

  14. Monitoring System • Total Hits Based on all traffic and criminal arrests • 2016 (to date) 4,904 hits • 27 Charges for Alcohol/Drug Offenses • 34 Misdemeanor Charges • 3 Felony Charges
