6. 6 What does a safety and health representative do? Represents:
fellow workers in matters relating to safety and health in the workplace
Is consulted:
by the mine manager about intended changes to the mine, plant or substances where changes may reasonably be expected to affect employees’ safety or health
Can be present:
at an employer’s or manager’s interview with an employee concerning the occupational safety and health of mine workers
7. 7 What does a safety and health representative do? cont. Can inspect:
any part of a mine as agreed with mine manager or as otherwise provided for in the Act
Reports:
immediately to the mine manager and employer any hazard or potential hazard
Can carry out appropriate investigation:
in the event of accident, dangerous occurrence or where there is risk of imminent and serious injury
8. 8 What does a safety and health representative do? cont. Consults:
and cooperates with the mine manager and employers about all safety and health matters at the mine
Refers:
appropriate matters to the safety and health committee
Can issue:
provisional improvement notices (PINs) after completion of the relevant training
Liaises with:
employees, employers and inspectors about safety and health matters

10. 10 General duty of care Each person who works on a mine is responsible for:
their own safety
the safety of others affected by their actions or inactions
11. 11 Duty of care — employee Anyone who works at a mine is an employee
Employees must:
comply with instructions on safety and health
use personal protective clothing and equipment provided
not misuse or damage equipment
cooperate with employers and managers on safety and health matters
underground workers must report on the state of the workplace at the end of a shift
12. 12 Reporting Every person working on a mine must report:
any potentially serious occurrence
any situation that could be a hazard
any injury
On receiving a report, the manager must:
investigate the situation
decide action to be taken
notify the person who made the report

14. 14 Duty of care — employer Employers must:
provide and maintain a safe workplace
provide information, instruction, training and supervision of employees
consult and cooperate with safety and health representatives and employees about safety and health matters
where appropriate provide employees with adequate personal protective clothing and equipment
ensure the safe use, maintenance, transport and disposal of plant and substances
15. 15 Duty of care —principal employer and manager The principal employer and manager must ensure the mine entries and exits (including access roads) are kept free of hazards to:
ensure workers and visitors can get in and out of the mine site safely
allow people to exit quickly if there is an incident where evacuation is needed
16. 16 Duty of care —principal employer to contractors Where a principal employer engages a contractor, the principal has a duty of care to:
the contractor
employees of the contractor
others engaged by the contractor
The duty applies only to matters over which the principal has control
17. 17 Duty of care — contractors Contractors have a duty of care to their own employees
Contractors have a duty as an employee to the principal
18. 18 Labour hire arrangements Both the labour hire company and the mining company owe a duty of care to the hired workers
They are required to provide and maintain a safe working environment
19. 19 Duty of manufacturers etc. Designers, manufacturers, importers and suppliers must ensure that any plant used in a mine is safe to install and use
They must:
identify possible hazards
assess the risk
reduce the risk
