SNYDER BROTHERS INC MAJOR OIL SPILL “SUB-AREA PLANNING IN THE FOREST” • DURING THE WEE, OVERNIGHT HOURS OF SATURDAY AUGUST 16, 2008 AND SUNDAY, AUGUST 17, 2008, SEVEN (7) CRUDE OIL TANK INSTALLATIONS OWNED/OPERATED BY SNYDER BROTHERS INC WERE VANDALIZED. • CRUDE OIL WAS DISCHARGED FROM THREE (3) OF THE TANK INSTALLATIONS TO THE NORTH FORK OF CHAPPEL FORK CREEK (NORTH FORK) AND INTO INDIAN RUN, A TRIBUTARY OF THE NORTH FORK. • NORTH FORK IS A TRIBUTARY OF CHAPPEL FORK. • CHAPPEL FORK IS TRIBUTARY TO CHAPPEL BAY OF THE ALLEGHENY RESERVOIR (ALLEGHENY RIVER). • APPROXIMATELY 6 MILES OF STREAM WAS IMPACTED BY THE SPILL. • THESE STREAMS ARE HIGH-QUALITY STREAMS WITH NATURALLY PRODUCING WILD TROUT POPULATIONS.

  4. SNYDER BROTHERS INC MAJOR OIL SPILL “SUB-AREA PLANNING IN THE FOREST” • THE CRUDE OIL TANK INSTALLATIONS ARE OWNED BY SNYDER BROTHERS, INC. A SNYDER BROTHERS WELL TENDER NOTICED THE VANDALISM DURING ROUTINE CHECKS AT APROX 0100 HOURS ON 08/17/08. • TOM DEFIBAUGH FROM SNYDER BROTHERS CONTACTED PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION (PADEP) DUTY OFFICER BUZZ HIMES TO REPORT THAT VANDALS HAD OPENED VALVES ON STOCK TANKS AND THAT 200 BBLS OF CRUDE OIL MAY HAVE BEEN LOST FROM ONE (1) TANK BATTERY ALONE. • PADEP DUTY OFFICER BUZZ HIMES REPORTED THE INCIDENT TO THE NATIONAL RESPONSE CENTER (SEE NRC CASE NUMBER 880873) AT APPROX 1158 HOURS ON 08/17/08. • EPA DUTY OFFICER, OSC RICH FETZER, RECEIVED THE REPORT FROM THE NRC AT APPROX 1219 HOURS.

SNYDER BROTHERS INC MAJOR OIL SPILL “SUB-AREA PLANNING IN THE FOREST” • APPROX 1255 HOURS, OSC ZENONE WORKING IN THE IN NORTHWESTERN PENNSYLVANIA SUB-AREA ON OTHER OPA REMOVAL PROJECTS, RECEIVED NOTIFICATION VIA TELECOMS FROM EPA DUTY OFFICER, OSC RICH FETZER. • APPROX 1307 HOURS: OSC ZENONE CONTACTED PADEP-ERP BUZZ HIMES VIA TELECOMS, GATHERED ADDITIONAL INFORMATION AND OFFERED FEDERAL ASSISTANCE AS MAY BE NEEDED. • WITH THE RESPONSIBLE PARTY (RP) BEING RESPONSIVE AND A CLEANUP CONTRACTOR (WEAVERTOWN ENVIRONMENTAL GROUP) HIRED AND ENROUTE, NO EPA ASSISTANCE WAS DETERMINED TO BE NEEDED AT THIS TIME. SHOULD CONDITIONS CHANGE, AND EPA ASSISTANCE IS DEEMED NECESSARY, PADEP TO CONTACT THE OSC DIRECTLY.

SNYDER BROTHERS INC MAJOR OIL SPILL “SUB-AREA PLANNING IN THE FOREST” • APPROX 1323 HOURS: OSC ZENONE CONTACTED AND BRIEFED NON-DUTY-HOURS DUTY OFFICER RICH FETZER ON THE STATUS OF THE INCIDENT. • APPROX 1535 HOURS: OSC ZENONE CONTACTED SNYDER BROS REP, TOM DEFIBAUGH, LEFT VOICE MAIL MESSAGE FOR RETURN CALL REGARDING THE INCIDENT. • APPROX 2107 HOURS: VIA RETURN CALL FROM SNYDER BROTHERS REP TOM DEFIBAUGH, OSC ZENONE GATHERED ADDITIONAL INFO: • SEVEN (7) TANK INSTALLATIONS (20 -22 TANKS), GAS COMPRESSOR AND WELLS VANDALIZED BY UNKNOWN PARTY. • APPROX 300 - 400 BBLS LOST FROM THE TANKS . YET-TO-BE DETERMINED QUANTITY OF CRUDE OIL ESCAPED SECONDARY CONTAINMENT ENTERED INTO WETLAND/ BEAVERDAM AREAS, INDIAN RUN, NORTH FORK, CHAPPEL FORK, AND CHAPPEL BAY ALLEGHENY RESERVOIR (ALLEGHENY RIVER). • BASED UPON THE MAGNITUDE OF THE DISCHARGE, OSC ZENONE VERBALLY SERVED “LEGAL NOTICE TO SUSPECT DISCHARGER” (FEDERAL INTEREST), AND SHOULD THE RP BE UNABLE OR UNWILLING TO CONTINUE/COMPLETE THE REMOVAL UNDER STATE OVERSIGHT, THE OSC WILL ASSUME LEAD AGENCY RESPONSIBILITIES.

SNYDER BROTHERS INC MAJOR OIL SPILL “SUB-AREA PLANNING IN THE FOREST” • ON 08/18/08, OSC ZENONE OBLIGATED FUNDS FROM THE OSLTF FOR EPA REIMBURSABLE COSTS, AND RESPONDED TO THE SCENE TO PROVIDE TECHNICAL ASSISTANCE TO THE INCIDENT COMMAND (PADEP, USFS-ANF, SNYDER BROTHERS). • AT APPROX 1300 HOURS, THE OSC ARRIVED ON-SCENE; MET WITH INCIDENT COMMAND, EVALUATED THE SITUATION TO DETERMINE THE APPROPRIATE LEVEL OF FEDERAL (EPA) REMOVAL RESPONSE ACTIVITIES. PRIOR TO THE OSC’S ARRIVAL ON-SCENE, INCIDENT COMMAND HAD COORDINATED EFFORTS TO SECURE THE IMMEDIATE SCENE (AT THE TANK INSTALLATIONS); FABRICATED A CONTAINMENT/RECOVERY LOCATION (UNDERFLOW DAM) ON THE NORTH FORK; DEPLOYED SORBENT PADS AND BOOMS ALONG INDIAN RUN, NORTH FORK AND CHAPPEL FORK; AND ESTABLISHED PRIMARY, SECONDARY AND TERTIARY CONTAINMENT/RECOVERY LOCATIONS ON CHAPPEL BAY. • AT APPROX 1600 HOURS, IN FOLLOW-UP TO VERBAL NOTICE, THE OSC ISSUED WRITTEN “LEGAL NOTICE TO SUSPECT DISCHARGER” (FEDERAL INTEREST) TO SNYDER BROTHERS REP BRIAN SNYDER.

SNYDER BROTHERS INC MAJOR OIL SPILL “SUB-AREA PLANNING IN THE FOREST” • SUBSEQUENT TO INCIDENT COMMAND MEETING, THE OSC MET WITH AND INFORMED INCIDENT COMMAND (PADEP AND USFS) THAT THE RESPONSE WAS BEING IMPLEMENTED ADEQUATELY AND THAT AS LONG AS SNYDER BROTHERS WERE BEING RESPONSIVE, EPA’S ROLE WOULD CONTINUE TO BE PROVIDING TECHNICAL SUPPORT, ADVICE AND GUIDANCE TO INCIDENT COMMAND.
