  2. NPDES Permits NPDES Permits are issued for the discharge of municipal, industrial, or commercial (non-storm water) wastewater and the discharge of storm water to State surface waters. These discharges are regulated under Act 451 of 1994 as amended

  3. NPDES Permit Fees On April 21, 2004, Act 91 of 2004 amended Act 451. The amendment increased fees for storm water discharges and incorporated fees for non-storm water discharges.

  4. NPDES Permit Fees • There are two types of fees associated with storm water discharges. • An annual fee, which is due in March - industrial or municipal separate storm sewer systems (MS4s) • A one time application fee for construction sites with 5 acres or more of earth disturbance. • There are two fees associated with non-storm water discharges. • An application fee, due with the application • An annual fee, due in January of each year.

Non-Storm Water Application Fees(municipal, industrial commercial) EPA major facility, individual permit $750.00 EPA minor facility individual permit, $400.00 CSO permit, wastewater stabilization lagoon individual permit EPA minor facility, general permit $75.00 Note: The application fee is due when the application is submitted. Applications with out the fee are incomplete and can not be processed.

Non-Storm Water Annual Fees(municipal, industrial commercial)Agricultural Purpose Fees Individual or General Permits $600.00 Unless the facility is an: EPA Major Facility $8,700.00 (excluding Farmers’ Cooperative Corporations) Or an EPA Minor Facility $150.00 (must qualify for a low-flow general permit)

  13. Fee Non-Payment Penalties Non-payment of fees is a violation of Part 31 of Act 451 and could result in compliance action or revocation of the permit. Non-payment of annual fees is subject to action by the Attorney General
