Quality of services • Unknown but essential chapter of the SD • Objective: to foster the high quality of services and to enhance information and transparency relating to service providers and their services. • Development of a policy on quality as vital for the proper functioning of the Internal Market
Quality of servicesInformation and assistance for recipients of services • MS shall ensure that service recipients can obtain, in their country, general information on the requirements applicable to service providers established in other MS • Mutual assistance between the different bodies.
Quality of servicesInformation on providers and their services • Obligation for service providers to make available certain information about them and their services • Indispensable information • Information on request • Information has to be clear and unambiguous. • For service providers to decide by which means or support they want to provide the information.
Quality of servicesProfessional liability insurance • Insurance obligations for service providers presenting particular risks • Art 23 encourages MS to require service providers established on their territory • Insurance should be appropriate to the nature and extent of the risk • Non duplication of insurance or guarantees requirements
Quality of servicesCommercial communications by regulated professions • Notion of commercial communications : any for communication aiming to promote services or the image of a service provider • All total bans have to be removed • MS will have to removed unnecessary restrictions while safeguarding the independance and integrity of regulated professions.
Quality of servicesMultidisciplinary activities • Objective: to remove requirements restricting the exercise of different activities jointly or in partnership • MS have to ensure the absence of conflicts of interest and incompatibilities between certain activities • For regulated professions and certification/accreditation services, restrictions can be maintained if justified and proportionate.
Quality of services- Settlement of disputes- • Improving handling of complaints by service providers • Financial guarantees in the event of judicial decisions
Quality of services - Voluntary quality enhancing measures- • Art 26: MS have to encourage voluntary quality enhancing measures by professional associations • Art 37: MS have to encourage the draw up of Codes of conduct at Community level • Public consultation of DG MARKT in 2007 on codes of conduct • Publication by DG MARKT of a Paper on European Codes of conduct objective: development of common rules at Community level
