Purpose Participants will gain knowledge and understanding of the legal requirements of State Program for English learners (ELs), specifically the English Learner Advisory Committee (ELAC) and the District English Learner Advisory Committee (DELAC)
State Program for English Learners • State and federal laws require the California Department of Education (CDE) to monitor the EL Program in school districts and county offices of education • The CDE uses the Federal Program Monitoring (FPM) process to monitor school districts’ compliance with specific tenets of the law • The EL Program Instrument is the monitoring tool for the EL Program, now in the California Accountability and Improvement System (CAIS)
State Program for English Learners English Learner Advisory Committees Required • Establishment of a functioning ELAC (I-EL 2) • Establishment of a functioning DELAC (I-EL 3)
English Learner Advisory Committee A school site with 21 or more ELs has a functioning ELAC that meets the following requirements: • Parent members are elected by parents or guardians of ELs
English Learner Advisory Committee (continued) • Parents and/or guardians of ELs constitute at least the same percentage of the committee membership as their children represent of the student body
English Learner Advisory Committee (continued) • The school may designate an existing school level advisory committee, or subcommittee of such advisory committee, to fulfill the legal responsibilities of ELAC, if the advisory body meets the criteria in (b) (Parents and or guardians of ELs constitute at least the same percentage of the committee membership as their children represent of the student body)
English Learner Advisory Committee (continued) d) The ELAC advises the school site council (SSC) on the development of the Single Plan for Student Achievement (SPSA)
English Learner Advisory Committee (continued) • The ELAC advises the principal and staff on the school’s program for ELs
English Learner Advisory Committee (continued) • The ELAC shall be responsible for advising the principal and staff in the development of a detailed master plan for bilingual education for the individual school and submitting the plan to the governing board for consideration for inclusion of the district master plan. It shall also be responsible for assisting in the development of:
English Learner Advisory Committee (continued) • Needs assessment • Language Census Report 3. Efforts to make parents aware of the importance of regular school attendance
English Learner Advisory Committee (continued) • The ELAC receives training materials and training, planned in full consultation with committee members, to assist members in carrying out their legal responsibilities
English Learner Advisory Committee(continued) h) Financial resources may be allocated for reasonable expenses (which may include transportation, child care, translation services, meals, and training) of parent advisory groups on bilingual-bicultural education, at the school and school district incurred in the course of their duties as members of the parent advisory groups
English Learner Advisory Committee (continued) i) The ELAC has the opportunity to elect at least one member to the DELAC or has participated in a proportionate regional representation scheme when there are 31 or more EL parent advisory committees in the district
Sample of Evidence for Compliance • Documentation of election process • List of current ELAC members • Agendas, minutes/meeting notes, and sign-in lists of ELAC meetings for the last twelve months that show all of the required tasks were completed
Sample of Evidence for Compliance (continued) • Documentation demonstrating that training was provided to members on their legal responsibilities in full consultation with its members • Evidence to indicate how and when advice was provided to site principal and staff by ELAC on all legally required areas
District English Learner Advisory Committee A LEA with 51 or more ELs has a functioning DELAC or a subcommittee of a existing district committee in which at least 51 percent of the members are parents (not employed by the district) of ELs
District English Learner Advisory Committee (continued) • The DELAC advises the district governing board on the following tasks: • Development of a district master plan for educational programs and services for ELs that takes into consideration the SPSA
District English Learner Advisory Committee (continued) • Conducting a district wide needs assessment on a school-by-school basis • Establishment of district program goals and objectives for programs and services for ELs
District English Learner Advisory Committee (continued) • Development of a plan to ensure compliance with any applicable teacher and instructional aide requirement • Administration of the annual language census report
District English Learner Advisory Committee (continued) 6. Review and comment on the School District’s reclassification procedures 7. Review and comment on the written notifications required to be sent to parents
District English Learner Advisory Committee (continued) • The LEA provides training materials and training, planned in full consultation with committee members, appropriate to assist members in carrying out their legal advisory responsibilities
