Projects and Participation • The CP is has taken off: - 5 projects running: • CP 1. Harmonisation of Classification • CP 2. Convergence of Class headings • CP 3. Absolute Grounds – Figurative Marks • CP 4. Scope of Protection B&W Marks • CP 5. Relative Grounds – Likelihood of Confusion - 95 individuals working on the CP from 25 EU offices • - 4 Non-EU offices as observer (NO, CH, TR, HR) • - 9 User Associations as observer • - WIPO
Participation in Working Groups 2012 All National Offices participate at least in one of the projects. Most Offices participate in all. Convergence of Class Headings • Translation / endorsement of taxonomy with national offices • Class scopes
Convergence Programme - Progress • 3 new projects • CP3. Absolute grounds – Figurative trade marks • when does a figurative mark, containing purely descriptive /non distinctive words, pass the absolute grounds examination because the figurative element renders sufficient distinctive character. • CP4. Scope of protection B&W marks • Do trade marks exclusively in black, white and/or shades of grey cover any/all colours or not? • CP5. Relative grounds – likelihood of confusion • How to deal with non-distinctive/weak components of trademarks in the context of the examination of relative grounds for refusal (likelihood of confusion).
