LB54 Statutory Lien Filing Changes. Effective July 1, 2001, LB54 Changes how “Statutory Liens” are filed with the Secretary of State, UCC Division. Agister’s Liens (§54-201) Feed Liens (§54-208) Artisan’s Lien (§52-202) Threshers Lien (§52-501) Fertilizer/Ag Chemical Lien (§52-1101).

Why the Change • RA9 Uniform Commercial Code • 9-310 “A (UCC) financing statement must be filed to perfect all security interests and agricultural liens” • To avoid dual filing or changing the code LB 54 changed the filing requirements • Language was added to each statutory lien section: “A lien created under this section shall be perfected as provided in Article 9, UCC”
How to File? • File the Statutory Lien as you would any UCC Filing with a UCC1 Filing Form • Attach the necessary statutory lien information • You may use the “universal” form included in the seminar materials for your attachment--except for agricultural production input (API) liens • Use the API form as the attachment for Ag. Input Liens • PLEASE type or Print Legibly
Fees • Standard UCC filing fee $6.00 • $.50 per page for any attachments • No fee for terminations
