Purpose of Anti-Bullying Bill of Rights Act • Improve Harassment, Intimidation & Bullying (HIB) laws adopted in 2002 • Establish clearer standards for the definition of HIB • Clarify and strengthen standards on prevention • Reduce the risk of suicide • Improve prevention programs and reporting procedures
Chapter 122 – Bullying Law Definition of Bullying “Harassment, intimidation or bullying” means any gesture, any written, verbal or physical act, or any electronic communication, whether it be a single incident or a series of incidents, that is reasonably perceived as being motivated whether by any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory disability, or by any other distinguishing characteristic, that takes place on school property, at any school-sponsored function, on a school bus, or off school grounds as provided for in section 16 of P.L.2010, c.122 (C.18A:37-15.3), that substantially disrupts or interferes with the orderly operation of the school or the rights of other students
District Anti-Bullying Coordinator (ABC) • Coordinates and strengthens the school district’s HIB policies to prevent, identify and address HIB of students • Collaborates with the school anti-bullying specialist(s), BOE and the Chief School Administrator to prevent, identify and respond to HIB acts in the district • Arranges for data collection • Meets with School Safety Team
District Anti-Bullying Specialist (ABS) • Chairs the School Safety Team • Leads, in coordination with the principal, the investigation of reported HIB incidents • Acts as the primary school official responsible for preventing, identifying and addressing incidents of HIB in the school • Engages colleagues and school committees in HIB prevention • Builds community relationships
School Safety Team (SST) • A School Safety Team is required in each school • The SST must consist of the principal or designee, a teacher in the school, an ABS, a parent of a student in the school, and other members determined by the principal • Develops, fosters, and maintains a positive school climate by focusing on the ongoing, systemic practices in the school and addressing climate issues, such as HIB
Building Principal determines if situation is a HIB incident Any staff member reports a possible HIB incident to building principal Reports of HIB Yes No Principal determines appropriate action Principal refers staff who reports incident to Bullying Specialist for a full investigation Bullying specialist meets with building Principal providing summary of investigation. Parents of all students are notified Principal determines outcome and provides Superintendent with a summary of consequences Superintendent reports to the Board of Ed
