2. Whatis a TVDL? On January 27, 2013, Governor Pat Quinn signed into law SB 957, which allows any immigrant who cannot get a Social Security number to get a Temporary Visitor’s Driver’s License (TVDL) to drive legally.

3. Whatis a TVDL? TVDLs are currently available to some visa holders (visitors, students, relatives of foreign workers) who cannot get Social Security numbers. SB 957 makes TVDLs available to undocumented immigrants who also cannot get Social Security numbers.

4. Whatis a TVDL? TVDLs are visually different from regular licenses and are “Not Valid for Identification.”

5. What does “Not Valid for Identification” mean? A TVDL is not valid for federal identification purposes, and such cannot be used to: Other institutions, such as hospitals and first responders, can use TVDL as identification. • Vote • Buy arms • Enter federal buildings • Board a plane

6. Why TVDLs instead of regular licenses? Under federal law, driving documents for undocumented immigrants must be visually different and must be marked as not valid for identification. TVDLs, which are already issued to some people with legal status, already comply with this law, but do not mark people as undocumented.

7. Qualifications • Must have a valid passport or consular ID • Must have lived in Illinois at least 1 year • Must produce any other required documents • Must pass vision, written, and driving tests • Must show proof of insurance for vehicle • Must pay $30 fee

8. When will TVDLs be available? SB 957 takes effect on November 28, 2013 – 10 months after Gov. Quinn signed it. The Secretary of State (SOS) is implementing this law gradually, starting in December and rolling out to 35 facilities by February 2014. (We know 25 of the sites already.)

11. What will the process be? • Applicants need to make appointments by phone (855-236-1155) or online (www.cyberdriveillinois.com). • At the appointment, applicants will provide all documents, get photographed, and take their tests.

12. What will the process be? • SOS will not issue TVDLs on the same day; it will review all documents and run a facial scan of the photograph. • If SOS approves the application, it will send the TVDL by mail.

Documents needed • One valid passport or consular ID • One document with written signature (passport or consular ID or certain other documents) • Two documents showing current address • One document proving Illinois residence at least 12 months prior to application • Proof of name change (if applicable)

16. Documents—current address • Individual Taxpayer Identification Number (ITIN; issued by the Internal Revenue Service; must have complete address) (this refers to the IRS letter) • Insurance Policy (homeowner's or renter's) • Medical Claim or Statement of Benefits from Private Insurance Company or Public (government) Agency (dated within 90 days prior to application) • Official Mail from a State, County, City, Village or Federal Agency (that includes the applicant's first and last name and complete address)

17. Documents—current address • Report Card from Grade School/High School/College/University • Selective Service Card • Tuition Invoice or Other Official Mail from a College or University (dated within 90 days prior to application) • Utility Bill (electric, water, refuse, telephone (land or cell), cable or gas; dated within 90 days prior to application)

Documents- 1 year of Illinois residence • Official Mail from a State, County, City, Village or Federal Agency (that includes the applicant's first and last name and complete address) • Pension or Retirement Statement • Report Card from Grade School/ High School/ College/ University • Tuition Invoice or Other Official Mail from a College or University • Utility Bill (electric, water, refuse, telephone (land or cell), cable or gas)

20. Documents- 1 year of Illinois residence TVDL applicants must fill out a “Verification of Residency” form listing their addresses during the past 12 months. SOS is NOT asking for names and contact information for property owners or managers.

21. What if I have a prior driving record? • TVDL applicants need to finish serving any suspensions for previous violations, including driving without a license. • Suspensions start when SOS created the record of the violation—NOT when the applicant applies for a TVDL. In most cases, the suspension will already be over before the person applies.

22. Whatif I have a DUI orhavehad a DUI? • You have to finish your suspension and pay all your tickets associated with your arrest. • After you have completed these steps you will have to go to the Secretary of State to begin the reinstallation process and then apply for a TVDL.

23. What if I used a fake name or Social Security number to get a license? • TVDL applicants will be matched (through facial scans) with their previous records. • They will need to serve a twelve-month suspension before they can get a TVDL. • Anyone interested in a TVDL can come forward NOW to start their 12-month suspension — BUT be aware of possible immigration consequences if your previous fraud is disclosed.

24. Whatif the police pulls me over with a TVDL? TVDLs can be used as bond in a traffic stop. The officer should write you a ticket for your violation and let you go without arresting you. TVDLs are valid ONLY IF the driver has proof of insurance for the vehicle. If you do not prove you have insurance, you can be ticketed for driving without a license.

25. Will the police know if someone with a TVDL is undocumented? TVDLs are available to both documented visa holders and immigrants without visas. The police cannot assume that you are undocumented because you have a TVDL. ICIRR Family Support Hotline: 1-855-435-7693

26. Know Your Rights With Police WHAT TO DO WHAT NOT TO DO • DO tell the police your name BUT NOTHING ELSE • DO tell the police you want to remain silent and want to talk to a lawyer. They should stop questioning you after that. Ifthe POLICE arrestyou: • DO ask if you can park your car in a safe place or have a licensed driver take it away, to avoid towing or impoundment fees. • MEMORIZE phone numbers for three family members or friends who you can call. IfyoufeelyouhavebeendiscriminatedbythePolicetakedowntheofficersbadgenumber • DON’T LIE. Tell the police you want to remain silent. DON’T give explanations, excuses, or stories. • DON’T SIGN any document if you don’t know what it is. • DON’T DISCUSSyour citizenship or immigration status with anyone other than your lawyer • DON’Thave any objects hanging from your rearview mirror. It may provide a pretext to pull you over

27. Watch out for notarios/fraudsters! Notarios and otherscamartists are already claiming to “help” people get TVDLs. • Only SOS can issueTVDLs. • No one needs to “help” you get an appointment. • TVDLs cost only $30—no additional fees are necessary. • All SOS materials are free DON’T getripped off byscamartists!!
