Variance Criteria 1. Extraordinary and exceptional conditions related to parcel size, shape, topography – No, parcel is commercial platted lot. 2. Application of the land development code standards to the property creates an unnecessary hardship – No, standards can been met. 3. Conditions are peculiar to the piece of property, not created by the actions of the applicant – No, conditions are not related to parcel configuration. 4. Relief (variance) does not cause substantial detriment to the public health, safety, welfare and morals or impair the purpose and intent of this article – Yes, approval will not cause substantial detriment to the public nor impair the purpose and intent of this article. 5. Use of land or building permitted by code – Yes, hotel is permissible use in General Commercial (COM-2).
Recommendation • Denial of Application VR-OTH-08-03 because variance criteria nos. 1, 2, and 3 of the LDC have not been met. Should the Planning and Land Development Regulation Board determine the variance is justified because: • Only 25% of the northern landscape buffer is affected by the encroachment; • The applicant has taken measures to reduce the degree of variance; • Supplemental planting along the north buffer (rear of the convenience store with gasoline sales), will off set any reduction in buffer width and compensate for the expanded driveway entrance; Staff recommends the following: 1. One existing parking space adjacent to the fast food restaurant driveway encroachment be removed and sodded; 2. Six additional medium shade trees, either Dahoon Holly or Ligustrum, shall be planted along the northern property line. Installation shall consist of two medium trees between each of the existing oak trees. The purpose of the trees is to offset the reduction in buffer width and compensate for the expanded driveway entrance.
