The Establishment Clause • “Congress shall make no law respecting an establishment of religion” • What does this mean? • Not legally tied together-no national religion • Lemon Test-neutral towards religion
“Free Exercise Clause” • “Congress shall not prohibit the free exercise of religion” • Reynolds v. US: (1879) Mormon practice of polygamy (having more than 1 spouse) is unconstitutional-violated standards of decency, morality and public order • Not always consistently enforced-animal sacrifice allowed
