  4. The Bill of Rights • The Bill of Rights are the first 10_ amendments to the Constitution • they were ratified by Congress and the states in the year 1791

  5. 1st:Freedom of expression Freedom of Speech, religion, expression

  6. The Establishment Clause • “Congress shall make no law respecting an establishment of religion” • What does this mean? • Not legally tied together-no national religion • Lemon Test-neutral towards religion

  7. “Free Exercise Clause” • “Congress shall not prohibit the free exercise of religion” • Reynolds v. US: (1879) Mormon practice of polygamy (having more than 1 spouse) is unconstitutional-violated standards of decency, morality and public order • Not always consistently enforced-animal sacrifice allowed

  11. 3rd: No Quartering Troops/Soldiers You cannot be forced to have soldiers live in your home

  12. 4th: No unreasonable Search and seizures Cannot be searched w/o probable cause and a warrant

  14. 5th: Rights of the Accused No double Jeopardy, must be read your Miranda rights of accused upon arrest, cannot be forced to incriminate yourself (plead guilty)

  16. 6th: Right to proper Criminal Proceedings Right to trial, judge, attorney, jury

  17. 7th: Right to Trial by jury Right to a jury of one’s own peers to determine guilt or innocence (innocent until proven guilty)

  18. 8th: No cruel or unusual punishments or excessivebail
