  2. BACKGROUND Report of the Northern Territory Board of Inquiry into the Protection of Aboriginal Children from Sexual Abuse, “Little Children are Sacred” in 2007 at recommendation 5: 5. That the government develop a whole-of government approach in respect of child sexual abuse. Protocols should be developed as a matter of urgency to enhance information sharing between agencies and the development of a coordinated approach in which all agencies acknowledge a responsibility for child protection…

  3. Background continued … CORONIALS • Inquest into the death of Kalib ‘Child 7’ (2007). Coroner identified inter-agency cooperation between police and (then) FACS to be inadequate. This problem extended beyond the jurisdiction of the NT. OTHER • Brain damaged baby (2009). Identified lack of inter agency collaboration between Health and (then) NTFC. • Malnourished infant continuously presenting at RDH (2009). Identified lack of collaboration between Health and (then) NTFC.

Background continued … Report of the Board of Inquiry into the Child Protection System of the Northern Territory 2010 • Chapter 11 details the topic of inter-agency collaboration and information sharing. • Identifies that current framework is complicated, legalistic and confusing. • Identifies the need for a whole of government responsibility of child protection. • Proposes both legislative and non-legislative responses to information sharing between agencies and NGO’s.

Legislative Reform Proposed Legislative Reform • Amending the existing provisions relating to information sharing in the Care and Protection of Children Act to be unambiguous and accessible • Drafting new provisions to fortify clear information sharing obligations • Creating a framework that operates across agencies and the NGO sector

  10. Practice Guidelines Proposed Practice Guidelines • Developing practice guidelines for frontline practitioners that is: • easy to read • easy to interpret • pro-information sharing for the safety and wellbeing of children • easy to find • rolled out across government

  11. Training Proposed Training • Developing a relevant training program that can be rolled out to Government agencies and the NGO sector.

  12. Code of Conduct Proposed Code of Conduct • Creating a Inter-agency Code of Conduct as the basis for the agreement to share information between agencies and work collaboratively for the protection and wellbeing of children that come into contact with Government.

OTHER PROPOSED REFORM Major Review of Care of Protection of Children Act • One of the significant legislative reform projects arising out of the Board of Inquiry into child protection in the Northern Territory report, Growing them strong, together is a major review of the primary child protection legislation, the Care and Protection of Children Act. • The reform process is underway. The Legislative Reform Team (DCF), will be seeking your advice with respect to known operational or legislative issues with the Act. The coordination and collation of proposed amendments is necessary for a comprehensive and consistent approach to legislative change.
