Adverse Action Triggers • Impairment – Characteristic or condition which may adversely affect the ability to render quality healthcare (3 Types: Professional, Behavioral, and Medical) • Misconduct – violations of criminal law or laws regulating the practice of medicine or allied health care professions
Privileging Authority Decisions • Type of investigation (preliminary or formal) • Removal from patient care duties • Abeyance (decision in 28 days) • Summary Suspension (= Hearing)
Hearing Procedures • Panel of 3 -5 Members • Represented by Counsel • Evidence disclosed in advance • Verbatim transcript • Written Panel Report • Respondent comments on Report • PA makes final decision
Appeal Rights • Respondent has 14 days to appeal • PA endorses appeal to BUMED • Standard for appeal – abuse of discretion • BUMED Legal reviews case file for compliance with due process, supporting evidence for decision, and seeks recommendation by Corps Chief
Surgeon General Decision • Case file reviewed by SG for decision • If appeal is denied, final adverse action is reported to NPDB, FSMB, and State(s) of Licensure • If appeal is granted, in whole or in part, case will only be reported if final decision is adverse • SG decision is final action on case
