Ministry of Public Administration and Justice In Hungary theregistration of the EGTC is a two-phaseprocess 1. APPROVAL CompetentAuthority: Ministry of Public Administration and Justice Department of Cross-Border Cooperations for Territorial PublicAdministration 2. REGISTRATION CompetentAuthority: Metropolitan Tribunal
Ministry of Public Administration and Justice To start theprocedureforapproval, thefollowingdocumentshaveto be attachedinHungarian: • Application (theapplication must includethename of theformed EGTC, itsregisteredseat, objectives and tasks) • The approvalshall be accompaniedbytheoriginalcopy of theConvention and theStatutessignedbythemembers of the EGTC, and countersignedby an attorney • The contributorydeclaration of theprospectivemember’ssuperior body
Ministry of Public Administration and Justice Characteristics of theapprovalprocess I. • The processproceedsaccordingtotheActongeneralrules of theadministrative and regulatoryproceduresandservices • The administrativedeadline is 30 days, whichbeginswiththearrival of therequesttotheauthorityofcompetence and scope of reference • The administrativedeadlineinreasonablecasesmay be onceprolongedby 30 days, beforetheexpiration of theregularadministrativedeadline • Iftheapplication is incomplete, thereare 8 daysforthecompletion of documents. The deadlineforthecompletion of documents is consideredintheadministrativedeadline. • Maximum 10 daysshall be providedforthecompletion of documents, whichmay be extendeduponrequestwith an additional 10 daysperiod.
Ministry of Public Administration and Justice Characteristics of the approval process II. • The authority may terminate the procedure, if the client did not meet the requirement for the completion of documents which was granted by his own request, and it did not apply for the extension of the deadline, and its absence of declaration making hindered the clarification of state of affairs. • Appeals: within 30 days, reference to legal offence, with an application addressed to the Metropolitan Tribunal, submitted to the Ministry of Public Administration and Justice for judicial review.
Ministry of Public Administration and Justice The approvalauthoritywillreviewduringtheapprovalprocess: • The mandatoryelements of theConvention and theStatutesdefinedbytheRegulation (Articles 8-9 of theRegulation) • Adequacytothe 1082/2006 EC Regulation, and tothenationallaw (public policy, public interest) • The approvalfromtheMemberState must refertotheparticipation of theprospectivemember • Inthecase of an EGTC of publicutility, it has to be inaccordancewiththeprovisions of theActonpublicbenefitorganisations.
Ministry of Public Administration and Justice Conclusions • The Hungarianapprovalorder is flexible • The decision is inthecompetence of oneadministrativeorgan, there is no designatedcoordinationorder • Itfunctionsaccordingtothedeadlinesboundbythenationallaw, theperiod of proceduremaynotexceed 3 months, asdefinedbytheRegulation • MOREOVER: The nationallawassigns an evenshorterdeadline: 30 day s+ 30 days + 10 days + 10days = 80 days • The approvalreferstotheparticipation of thefuturemembers
Ministry of Public Administration and Justice The most commonproblems and reasonsforrejectingapprovals: • Lack of thecontributorydeclaration of theprospectivemember’ssuperior body • The EGTC’splannedtasksare out of theEGTC’sscope, cannot be fulfilledby an EGTC • The primaryaim of thefuture EGTC is topursue business activities, whichinterfereswiththeHungarian and EU law
Ministry of Public Administration and Justice Provision of the 1082/2006 EC Regulation Hungarianposition Wesupport most of theCommission’samendingproposals, inparticular: • Participation of publicundertakingsin an EGTC • The option of establishingEGTCsbetween 1 MS and 1 third country oroverseasterritory • The factthatthe Madrid Conventioncanserveas a legalbasisforcooperation • Altoughwefindthe 6 monthsapprovalperiodtoolongwearevery happy withtheintroduction of thetacitapproval • Clarificationregardingthecontent of Convention and of theStatutes • Simplification of thejoiningprocedure ProposaltotheCommission: • Tocreate a Network of the National ApprovalAuthorities, asadvisedbytheCoRtoo
