Waste Framework Law & Obligations • Emergency Governmental Ordinance No. 78 from 2000, on waste regime, approved by Law No. 426/2001, with further amendments and completions • Emergency Governmental Ordinance. No. 61/2006 approved by Law No. 27/2007 • Subsequent legislation • Governmental Decision No. 856/2002 (O.J. No. 659/5.09.2002) regarding the evidence of waste management and for the approval of the list of wastes, including hazardous waste; • Governmental Decision No. 1470/2004 for the approval of the National Waste Management Strategy and National Waste Management Plan (O.J. No. 954 from 18 October 2004), amended by G.D. No. 358/11.04.2007, (O.J. 271/ 24. 04. 2007); • Ministerial Order no.1364/1499/2006 approving the Regional Waste Management Plans (O.J. 232/04.04.2007). • Romanian legislation transpose Waste framework Directive 2006/12/EC; new European legislation will be transposed until December 12 on 2010.
Waste Framwork Law & Obligations Producers’ obligations: • to provide the conditions necessary for a separate depositing of different categories of hazardous wastes and nature of the extinguishing substances used for each type of wastes in case of fire. to assure the recovery or disposal of the waste; • to appoint a person, an employee of the company, which has to follow and assure that the obligations of the waste holders/producers are fulfilled according to the law; • to allow the access of the inspecting authorities • to foresee and fulfill the measures that have to be taken after the end of the activities and closure of the sites; • to separate the waste, for recovery or disposal. • It is forbidden to mix different categories of hazardous wastes as well as hazardous wastes with non-hazardous wastes • to keep a record of the quantity, nature, origin, and if it is the case, the transport method and frequency, treatment method of waste, as well as the operation of disposal respectively recovery and to make them available to the competent authorities.
