  1. Participating Government Agency (PGA) Access to CBP’s ACE Portal

Security:Sensitivity of CBP Data • Customs and Border Protection (CBP) systems provide access to a variety of sensitive information: • Law Enforcement Data (Counter-Terrorism, Counter-Narcotics) • Trade-Sensitive Data (Business and Personal -Confidential) • Business Processes used by CBP to protect our borders and enforce our laws • Federal laws specify penalties for misuse: • Federal Information Security Management Act of 2002 • Trade Secrets Act • Privacy Act • Fines up to $100,000 and confinement up to 10 years are potential penalties associated with inappropriate disclosure of CBP data • If provided access, you must protect this information from unlawful disclosure! Please refer to the CBP IT Security Awareness and Rules of Behavior training manuallocated under the Security Tab of the PGA Resource Center (https://pga.itds.gov/feature.asp?action=fld&nav=31&id=31)

ACE Portal Access:Agency level requirements • All agencies that need to access data via ACE portal require an MOU with CBP • If your agency does not have an existing MOU with CBP: • Your agency may wait to access the ACE portal until an MOU with CBP is in place • Your agency may request a Letter of Exchange (LOE) with CBP. A sample request for an LOE is available on the Resource Documents page in the Library section of the PGA Resource Center (http://www.itds.gov/xp/itds/toolbox/library/resource_documents/) • Once an MOU or LOE is in place, the next step is to determine if individuals meet the security requirements for ACE access

ACE Access:Process for individual ACE access • All individuals who access the ACE Portal require an OPM BI (Public Trust Type 25) or equivalent • If you believe your clearance level with your agency is the same as, or similar to, the OPM BI, you may apply for access to the ACE Portal. • To apply, print and complete each of the following required documentation: • ACE Portal Access Application Form • CBP Form 7300 (requires your agency security office to certify OPM BI status) • DHS Non-Disclosure Form • DHS Rules of Behavior for PGAs Form • These forms are available on the Join Us page under Portal Access (http://www.itds.gov/xp/itds/join_us/)

ACE Access:BI Process (continued) • Completed forms may be scanned, saved into a password protected or encrypted file, and e-mailed to itdsportalaccess@cbp.dhs.gov • Alternatively, forms may be mailed to Donna Allen, the CBP SCO: • US Customs and Border Protection1400 L Street, NW, Cube 2S17Washington, DC 20229 • Once processing is completed, you will receive emails with information on accessing web-based training as well as logging into the ACE Portal.
