  3. What is Double Jeopardy? Being tried twice for the same crime. You can be tried twice for the same actions, but not the same crime (does not apply in civil cases – being sued)

  5. What is the Eighth Amendment? A protection against cruel and unusual punishment, allows for the death penalty – but some aspects of the death penalty have been declared unconstitutional – putting juveniles or mentally retarded to death, gas chamber is not allowed.

  7. Are there limits to our Freedom of Speech? Of course – you can’t shout “fire” in a crowded theater, you can’t slander someone…

  9. What does innocent until proven guilty mean? It’s the idea that if you’re arrested, the prosecuting attorney must prove you’re guilty – you don’t have to prove you’re innocent (like in France).

  11. What’s an indictment? When you’re arrested, they have to be indicted before a grand jury for the crime before you can be tried by a jury. It’s a constitutionally protected right.

  13. What is bail? Kind of like a deposit you put up if you get arrested. Then, when you come back to face trial, you get the money back. Even if you’re found guilty.

  15. What’s the idea of speedy and public trial? When you’re arrested, your trial won’t be unnecessarily delayed. You get in line with every other criminal and wait your turn for your trial. Hopefully, you’re out on bail and sitting in jail.

  17. What is the Fifth Amendment? Your constitutional right against having to testify against yourself – this can take many forms…you don’t have to take the stand in your own trial, provide evidence against yourself…
