  12. Employers Liability Compulsory Insurance • Employers Liability Compulsory Insurance – your current annual certificate must be completed and displayed in an area where all staff can see it. HWL Advisor must view or receive a copy of the certificate which must be less than one year old, renewed annually and belong to the organisation concerned Leaflets can be downloaded from: www.hse.gov.uk/pubns/hse40.pdf

All employers must have employers’ liability insurance except the following: • Most public organisations including: government departments and agencies, local authorities, police authorities and nationalised industries; health service bodies including National Health Service trusts, health authorities, primary care trusts and Scottish Health Boards; some other organisations which are financed through public funds, such as passenger transport executives and magistrates’ courts committees • If you work for one of these public sector organisations, you can still claim compensation if you are injured at work or become ill as a result of your work and your employer is to blame.   16. Smoking Signs In line with the Smoking, Health and Social Care (Scotland) Act 2005 You must display ‘No Smoking’ signs at the entrance to your premises. Samples of signs can be downloaded from: http://www.clearingtheairscotland.com The adviser must either have seen the statutory No Smoking signs or have evidence that they are displayed in the workplace e.g. photograph

Access to Competent advice Competence is based on: • Skills • Knowledge • Training • Experience • Understanding of legislative obligations relevant to the organisation • Due diligence • Awareness of limitations Competent Persons can be: • Workers from the organisation with the above referenced attributes • External Consultants / Advisors • Both of the above Adviser has viewed letter of engagement with external consultant OR Name and qualifications of internal appointment OR Supporting documentation on how the organisation has addressed the need for competent advice

Induction Training on Health and Safety Matters This must include: Fire First Aid Accident Reporting Hazard / Topic specific training for the job and organisation http://www.hsebooks.com – Ref: 0717626032 Organisation to provideevidence of content of training relating to fire, first aid information and accident reporting and Organisation to provide evidence /records of staff training Or Organisation to clearly explain where and how records are stored and where they could be viewed at audit

Accident and Incident Reporting Accident Book Written Procedure RIDDOR Over 3 day Major injury Dangerous Occurrence Incident Contact Centre Advisers would need to see a documented accident reporting system OR Written statement of how reporting is carried out plus a copy of a blank accident form or copy cover of current report form booklet
