Background to the setting up of GIPREB • In France, the subject of water is complex with many stakeholders involved: • Public services: central government ministries and regional and county-based services which are under the authority of the Préfets. • Application of national and European policies • Environmental Police, statutory power • Public bodies: Agence de l’Eau Rhône Méditerranée et Corse (Rhône, Mediterranean and Corsica Water Agency) • Taxes and subsidies • planning Regional Department of the Environment PACA – 2 July 2007

Background to the setting up of GIPREB • In France, the subject of water is complex with many stakeholders involved: • Local authorities: Regional Council, Departmental Council • Policy support, planning • Communes and groups of communes • Drinking water and decontamination, risk of flooding • Users • Professionals (Electricité de France, industry, fishermen and farmers) • Associations • Need for greater consultation above and beyond simple areas of competence Regional Department of the Environment PACA – 2 July 2007

The setting up of GIPREB in 2000 • To pursue the rehabilitation of the environment • Significant reduction in industrial pollution • But • Need for improvement in urban water treatment • Reduction of the impact of the EDF discharge • Work on other sources • Improvement of dialogue to establish a common action plan despite disagreements • Include these in an Etang Contract Regional Department of the Environment PACA – 2 July 2007

WHAT IT IS: A forum for discussion The joint monitoring of the environment A place for sharing information and data Drafting of common action plans A source of information WHAT IT IS NOT: A legal decision-making body A direct land management body A structure which carries out work No member is liable for a decision made by the GIP Public Interest Group (GIP) for the rehabilitation of the Etang de Berre (REB) The role of elected representatives in management is high (50 % of votes, one Chairperson) Regional Department of the Environment PACA – 2 July 2007

Example 1: European dispute • France has been found guilty by Europe: the impact of the EDF discharge into the Etang must be reduced • European negotiations for new limits for the discharge and increased monitoring of the environment • Legislation passed at a national level governing Electricité de France • Discussions with local stakeholders: • On the new restrictions, public enquiry in two Départments, preliminary dialogue with GIPREB • Biology section of environmental monitoring carried out by GIPREB Regional Department of the Environment PACA – 2 July 2007

Example 2: the Etang contract • Objective: Establish a 5-year common action plan • Commitment of funding bodies • Commitment made by those responsible to take action within their scope of responsibility • Development within GIPREB, • The signature of the contract is a moral commitment but is not legally binding Regional Department of the Environment PACA – 2 July 2007

The State-Region project contract • Agreed between the French government and the Regional Council for joint actions between 2007-2013 • Grant funding will be allocated (for the government via the Agence de l’Eau) • Actions in line with the Etang contract • A departmental section signed by Rhones-Alpes Departmental Council is anticipated • Signing the contract is a moral commitment but is not legally binding Regional Department of the Environment PACA – 2 July 2007

  11. Conclusion PRELIMINARY DISCUSSION AND DIALOGUE ARE THE FIRST PRIORITY • GIPREB brings together the stakeholders (even if opponents are outside) • Etang Contract • State-Region project contract • Each stakeholder works on the subject area in which it is legally competent on the basis of common elements and following discussion.
