This report provides an update on the recent customer transition activity, including market participant default and the efforts of the joint taskforce to minimize uplift exposure. It also includes information on the RMS and WMS TF meetings, TF recommendations, and upcoming meetings.

  1. Market Participant Default Joint Taskforce Update and Report on Recent Customer Transition Activity Report to TAC October 6, 2005

Taskforce Purpose • TAC created RMS/WMS joint taskforce to: • review current procedures for Market Participant default • determine whether improvements can be made • Objective of taskforce is to minimize or eliminate uplift exposure • From the initial Joint TF meeting: • Pre-triggering event issues to be addressed by WMS • Post-triggering event issues to be addressed by RMS • Joint meetings will be scheduled as needed

RMS TF Meetings • RMS Mass Transition TF met Monday 08/15/05 • Incorporated short-term recommendations into a Retail Market Guide Revision Request (RMGRR). • If LSE does not cure, defaulting LSE must provide ERCOT customer information.  • ERCOT is to send best available information to POLRs (either ESI ID list or customer information that has been obtained from defaulting REP) • In the event the defaulting LSE cannot provide ERCOT with customer information, POLR is to work with TDSP to obtain existing customer information. • POLR is to submit off-cycle, unprotected switch based on the first available switch date (currently, six Retail Business days).  These switches must be submitted within five Retail Business days of receipt of ESI ID information.  •  Educational seminar for POLRs, TDSPs, ERCOT, and PUCT Staff. • RMGRR 029 Mass Transition Process was reviewed at the 09/14/05 RMS meeting and remanded back to the task force to review procedure for ESI IDs with a peak demand above 1 MW.

RMS TF Meetings • The RMS Mass Transition TF met on 10/04/05. • Revisions to RMGRR 029 to clarify process to be utilized in the short-term for a mass transition ESI IDs with a peak demand above 1 MW to POLRs. • TF recommendations for long-term solution: • Request TX SET develop transactional solution for CR to CR transition • Request RMS Mass Transition TF develop requirements for a centralized repository for customer information • Next meeting of RMS Mass Transition TF: Thursday, 10/27/05 8:30 am – 2 pm ERCOT MET, 206B

WMS TF Meetings • Result of previous WMS TF meetings was the submission of two Protocol Revision Requests (PRRs): • PRR 624: Clarification of Market Participant Default Language • Proposes changes that strengthen or clarify Protocol language that address default situations. Much of language is based on language drafted for TNT Protocols. • Passed at the 09/29/05 PRS meeting. • PRR 625: Clarification of Emergency QSE Language • Proposes changes that strengthen or clarify Protocol language that address when and how Emergency QSEs may be used. • Further discussion at the 10/20/05 PRS meeting.

Recent Customer Transition Activity:REP Exits Market Monday, August 29, 2005 • A REP in the ERCOT Region made the business decision to exit the Market. • The REP represented approximately 600 ESI IDS and 40 MWh of load per day. • ERCOT began facilitating daily calls and checkpoints with PUCT and impacted TDSPs and POLRs. • ERCOT provided TDSPs and POLRs transition ESI ID lists and customer information available from REP. Tuesday, September 6, 2005 • Fifth business day since distribution of ESI ID list. Per RMS short-term recommendation, POLRs to have submitted initiating transactions for transition. • 99% of Initiating transactions submitted by POLRs.

Recent Customer Transition Activity:REP Exits Market Tuesday, September 13, 2005 (10th Business Day) • All Initiating transactions submitted by POLRs. • 60% of ESI IDs had transitioned away from exiting REP. Monday, September 20, 2005 • All ESI IDs had transitioned away from exiting REP. POLRs submitted off-cycle Switches to gain ESI IDs. • POLR submission times: • Two POLR submitted same or next day as receipt of lists. • One POLR submitted within 2 business days. • One POLR submitted within 2 - 10 business days (extended time was for minimal number of ESI IDs).

Recent Customer Transition Activity:MP Default Friday, September 9, 2005 • ERCOT initiated the Mass Transition process for the ESI IDs represented by USAVE Energy Services Inc., a Qualified Scheduling Entity (QSE) and Retail Electric Provider (REP) in the ERCOT Region. • USAVE represents approximately 550 ESI IDs and accounting for less than 65 MWh of Load per day. • ERCOT began facilitating daily calls and checkpoints with PUCT and impacted TDSPs and POLRs. • ERCOT provided TDSPs and POLRs transition ESI ID lists (no customer information available). Friday, September 16, 2005 • 100% of Initiating transactions submitted by POLRs. • Fifth Business Day of the transition.

  11. Recent Customer Transition Activity:MP Default Monday, October 3, 2005. • 99% of ESI IDs have transitioned away from defaulting REP. POLRs submitted off-cycle Switches to gain ESI IDs. • POLR submission times: • One POLR submitted same or next day as receipt of lists. • Two POLR submitted within 2-3 business days. • One POLR submitted within 5 business days.

ERCOT begins daily checkpoints with impacted TDSPs, POLRs, & PUCT MP defaults under Agreements with ERCOT Last ESI ID scheduled to transition away ERCOT provides ESI ID list to POLRs & TDSPs No customer info available. POLRs begin working with TDSPs. 5th Business Day – 100% of Initiating Transactions sent Recent Customer Transition Activity:MP Default Fr09/16 M09/26 Fr09/09 Customer transition in progress Customer transition should be completed in 11 Business or 17 Calendar Days
