12. The Juvenile OffenderThe Disobedient Child - 601 WIC Any person under the age of 18 years who persistently or habitually refuses to obey the reasonable and proper orders or directions of his or her parents, guardian, or custodian, or who is beyond the control of that person. Or who is under the age of 18 years when he or she violated any ordinance of any city or county of this state establishing a curfew based solely on age is within the jurisdiction of the juvenile court which may adjudge the minor to be a ward of the court. MBMC 4.124.010 Daytime Curfew is between 8:30 a.m. and 1:30 p.m. of the same day on days when said minor�s school is in session MBMC 4.56.030 It shall be unlawful for any minor to be present in or remain in or upon the public streets�, between the hours of 10:00 p.m. and 6:00 a.m.

13. The Juvenile OffenderThe Defiant Juvenile - 602 WIC With a few exceptions, any person who is under the age of 18 years when he or she violates any law of this state or of the United States or any ordinance of any city or county of this state defining crime other than an ordinance establishing a curfew based solely on age is within the jurisdiction of the juvenile court, which may adjudge such person to be a ward of the court.

14. Arrest/Detention 625 WIC A peace officer may, without a warrant, take into temporary custody a minor: (a) who is under the age of 18 years when the officer has reasonable cause for believing that the minor is a person described in section 601 or 602 WIC, or (b) who is a ward of the juvenile court� (c) who is under 18 years and found in any street or public place suffering from any sickness or injury which requires care, medical treatment, hospitalization, or other remedial care.

15. What About Their Rights? Miranda Rights Any minor detained per 625 WIC must be advised of their constitutional rights, including their right to remain silent, to have counsel present during any interrogation, and their right to have counsel appointed if they can�t afford it.

16. Now They�re In Custody, What Do We Do Now?626WIC An officer who takes a minor into temporary custody under the provisions of 625 WIC may do any of the following: 1. Release the minor 2. Deliver or refer the minor to a public or private agency with which the city or county has an agreement or plan to provide shelter, care, counseling or diversion services to minors so delivered 3. Issue a notice to appear 4. Take the minor without unnecessary delay before the probation officer In determining which disposition of the minor to make, the officer shall prefer the alternative which least restricts the minor�s freedom of movement, provided that alternative is compatible with the best interest of the minor and the community.

17. The Process of a Juvenile in Custody Transport the minor to the station Search the minor for weapons, contraband and property Interview minor Contact the minors parents Contact juvenile probation officer Fingerprint and photograph minor No later than one hour after minor has been taken into custody, the minor has the right to make at least two telephone calls, one call completed to their parent and one call completed to an attorney. If minor is released to his parent, complete Juvenile Court Notice to Appear Form. Minor�s court date is set for 60 days If minor is transported to Los Padrinos Juvenile Hall, complete Juvenile Hall Entrance Record, Probable Cause Declaration and attach crime and arrest reports. Minor�s court date is set within 48 hours.

18. Juvenile Court & Rehabilitation If the minor is found guilty they can be placed in any of the following programs: JOIN-Juvenile Offender Intervention Network Sponsored by the LA County District Attorney�s Office VORS-Victim/Offender Restitution Services Sponsored by Centinela Valley Juvenile Diversion Project Probation Department South Bay Youth Project California Youth Authority

19. Social Host Ordinance 4.128.020� Responsibility for proper property management. Every responsible person including but not limited to every owner, occupant, lessee or holder of any possessory interest of a residence or other private property within the City of Manhattan Beach is required to maintain, manage and supervise the property and all persons thereon in a manner so as not to violate the provisions of this chapter. The owner of the property remains liable for such violations regardless of any contract or agreement with any third party regarding the property.

20. Social Host Ordinance Cont. 4.128.030� Penalties for violation of this chapter. It is a civil violation of this chapter, and a public nuisance constituting an immediate threat to public health and safety warranting summary abatement, for any responsible person to conduct or allow a loud or unruly gathering at a residence or other private property at which service to, or consumption of alcohol or alcoholic beverages by, underage persons occurs. The citation shall also give notice of the right to request an administrative hearing to challenge the validity of the citation, the time for requesting that hearing and the warning relating to the recovery of response costs for subsequent citations under this chapter as described under Section 4.128.040.

21. Social Host Ordinance Cont. 4.128.100� Enforcement authority. A loud or unruly gathering at a residence or other private property at which service to or consumption of alcohol or alcoholic beverages by underage persons occurs constitutes a public nuisance and an immediate threat to public health and safety and shall be summarily abated by the Police Department by all reasonable means including, but not limited to, an order requiring the gathering to be disbanded and citation under this chapter as well as citation and/or arrest of any law violators under any other applicable ordinances and state statutes. The City Attorney and the Chief of Police, all sworn officers of the City and the City Manager are authorized to administer and enforce the provisions of this chapter. The City Attorney and the Police may exercise any enforcement powers provided by law in executing this chapter.
