Copyright 2015 Foyle legal all rights reserved Section 61 of the Workers Compensation and Injury Management Act says an employer cannot cease weekly payments of compensation except in the circumstances below. The employer can legally discontinue payments if the worker has ‘returned to work’ this does not just mean returned to ‘a job’ but has returned a wage earning member of the workforce in substantially the same role. If the employer wants to discontinue payments of compensation then they must provide the worker with a Notice to Worker of Intention to Discontinue or Reduce Payments. If this is received then the worker has 21 days to lodge an Application for Conciliation with WorkCover WA or payments of weekly compensation will be discontinued.
