A no fault divorce can be allowed on grounds such as irretrievable breakdown of the marriage, irreconcilable differences, incompatibility, or sometimes depending on the state. Here, nobody is blamed for the failure of the marriage.

  6. On the other hand, in fault divorces one party asks for a divorce claiming that the other party did something wrong. A few of the varied grounds for fault divorce include adultery, cruelty, mental illness, etc. Some states consider additional grounds such as drug abuse, impotency, and religious reasons. Just like there are grounds on which a party can blame the other party, there are also defenses that can be raised in response to such claims which include, an insufficiency of evidence, condonation, recrimination etc.
