  1. ConstructionLiens ALL YOU HAVE BEEN SEARCHING FOR, IS RIGHT HERE.

  2. Let'stackle thebasics A construction lien is a claim made against a property by a contractor/subcontractor who has not been paid for work done on such premises. Construction liens are designed to protect specialists from the risk of not being paid for services provided. It is also cited as a mechanic's lien.

  3. THE CASES In what circumstances, can you exercise a construction lien. A contractor/subcontractor can file a construction lien against a premise if the landlord has not paid for work done on it. A lien makes it difficult or impossible to sell or refinance a property. If you are dissatisfied with the quality of work done, it's your responsibility to seek a resolution.

  4. STEP-1 THEPROCESS PRELIMINARYNOTICE The only reason to send a preliminary notice is to secure your construction lien right on a project. This is not mandatory, but preserves your rights on a project, in case things don’t go as planned. Preliminary Notice helps you ensure your payment. If you haven’t filled a Preliminary notice, no need to worry, you can still file a construction lien. There are only a few states that don’t require a preliminary notice prior to a mechanics lien claim. However, we still recommend that you send a notice, even if you’re in a state where notice is not required. That’s because there are many more benefits to sending a notice other than just securing your lien rights.

  5. STEP-2 THEPROCESS NOTICEOFINTENT A notice of intent to lien or an intent notice or notice of non- payment – warns the property owner, prime contractor, and/or other parties that a construction lien or bond claim will be filed unless payment of the overdue amount is made within a certain period. Although only legally required in a few states, there are benefits to sending these notices for projects in any state, as they are reasonable and very efficient at producing payment.

  6. 7. How creditors collect payments If the lienholder wants to enforce their right to payment, this is done through a foreclosure action. A foreclosure action is a legal process initiated by a lender after a borrower defaults on their mortgage. What that means is that the collateral securing the debt will be seized and sold. After the sale, the proceeds will be distributed to pay off the liens on the property. Let'stalk payment. In the event of non-payment on a construction project, a payment bond is a form of security that allows covered parties to claim a third-party surety (typically an insurance company) for payment of materials and/or labor provided to a bonded project.

  8. Property canbe lienednot aperson. An important aspect of construction liens is that a valid lien attaches to the piece of property that’s being improved in the construction project. When you file a construction lien, the document is recorded with land records and appears on a title search of the property. Anyone who buys or accepts the property after the recording of your lien claim (and sometimes, in some states even before the recording), accepts it subject to the claim. As a practical measure, this means the property will not be sold, refinanced, or otherwise transferred without the construction lien claim being paid or addressed.

  9. OnLast Notes A Few Things to Keep in mind there are some broad notes to remember when attempting to a construction lien. Liens join to the property, not to an individual or an organization. As a rule, the individuals who perform work or supply materials on a development venture will reserve the option to lien the undertaking. The strategy for recording a Construction Lien differs state-by- state. In most states, sending a primer notification is a necessary advance to protect your construction lien rights Your lien should be documented inside a characterized time period When documented, a lien will lapse, and in certain states, they terminate rapidly
