Background • 2006: the price of metals increases leading to increase in sales of stolen metals. • 2006: Construction industry and scrap metal industry request City Council “add teeth” to scrap metal ordinance • 2006 – 2007: Darrin Hall & Sgt. McGinty work with stakeholders to draft changes 2
Background (continued) • March 21, 2007: Ordinance 2007-295 approved by City Council to reduce the sale of stolen goods to metal dealers – especially mobile metal dealers. New provisions: 1) must operate out of a fixed location; 2) penalties for non-compliance; 3) surety bond requirement; 4) uniform tracking requirements, including the requirement to videotape the purchased materials. • 2007 – 2009: As 2007 Ordinance changes are implemented, City staff work with industry to determine if the changes were sufficient, or more is needed. • December 9, 2009: Stakeholders (industry, ARA, HPD, Legal, Mayor’s Office of Government Affairs and Council Member Noriega’s Office review and agree to recommend revisions. 3
Overview of Recommended Changes • Eliminate Video Recording Requirement • Require digital pictures to be of sufficient clarity that the objects can be identified • Change Hours of Operation • For locations where more than one type of business activity is conducted, each activity must be permitted • Clarify the definitions of “fixed location” and “metal recycler/secondhand metal dealer” • Changes go into effect on January 1, 2010 4
