  2. All the information about affidavit is shared in this article. It explains that it is a statement which is voluntarily made by the affiant to the best of his knowledge and experience. An affidavit is a statement of facts made by the affiant himself under an oath administered by a person a person certified to do so by law. It is made on the basis of belief or the personal knowledge of the person. Recognition of facts by experience or direct observation is known as personal knowledge. The information and belief given by affiant are also based on knowledge. Distinctions An affidavit is a voluntarily made document made by the affiant without any cross examination given by him.

  3. A pleading is a request to the court to use its judicial power in support of the party who has allegations and conclusion of the facts which are not verified and it differs from an affidavit. The Affiant A person has the power to take an oath or who can confirm his knowledge of the facts on which dispute took place. A person should be mature enough to understand the importance of an oath to make an affidavit. A criminal cannot make an affidavit for himself on own. Someone who is well versed with matter can make an affidavit on behalf of another person. It is also possible that guardian makes an affidavit of a minor person or mentally retarded person. An attorney also can make an affidavit for a client in case the client is not capable of doing so.

  4. In the conditions of performing duties a personal representative, corporate officer, agent and partner can execute the affidavit on behalf of them. A court does not have the power to force anyone to make an affidavit because it is a voluntary statement according to its definition. The Affidavit Taker Any authorized public officer of the court to administer oath and affirmations like county clerk, notaries, court clerks, city recorders can take the affidavit. Sometimes higher authorities like magistrates and peace justice are also authorized to take affidavits.

  5. Any officer cannot take affidavit outside the jurisdiction in which he exercises the authority. At the bottom of the affidavit, the source of the authority must be mentioned. An affidavit does not need any official seal but it can be placed by an authorized person to make it authentic in front of a court.
