Affidavit.-An affidavit is a written statement of facts, sworn to and signed by an individual which is used mainly to support applications and in some circumstances, as evidence in court proceedings. The person who makes the affidavit must swear or affirm that the contents are true before a person authorised to take oaths in respect of the particular kind of affidavit. An affidavit shall include affirmation and declaration in case of persons by law allowed to affirm or declare instead of swearing. How to draft an affidavit.-The affidavit shall be confined to such facts as the deponent is able to state to his own knowledge except on interlocutory applications, on which statements of his belief may be admitted, provided that the grounds thereof are stated.
However, if the facts based on information received or upon the record are stated in the affidavit, the source of information or the particulars of record from the perusal of which facts have been known should be stated. The affidavit should be drafted carefully. The affidavit should not contain statements, for which there is no basis. If a practitioner prepares and files an affidavit containing statement which he knew or had strong reason to believe to be false, he shall be deemed to be guilty of professional misconduct. Therefore, the person drafting the affidavit should be very careful in drafting, and he should ensure that the material facts in the personal knowledge of the deponent or facts based on the information received or on the basis of record should be stated in the affidavit and the statement without any basis should not be stated.
Giving false evidence.-Whoever being legally bound by an oath or by an express provision of law to state the truth, or being bound by law to make a declaration upon any subject, makes any statement which is false, and which he either knows or believes to be false or does not believe to be true is said to give false evidence. Making false affidavit is an offence.-The person making an affidavit should be very careful as making false affidavit is an offence under section 191, Indian Penal Code.
