  3. Purpose To develop terms and conditions for permits and licences that provides clarity, consistency and certainty for the Boards and its clients. Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008

  4. Scope To identify a clear and consistent approach for the development of: New Terms and Conditions; A common approach for creating new Terms and Conditions; A common template for Land Use Permit and Water License Conditions; and A common and consistent approach to orphan measures.   7. Progress Step 1 Obtain and review the current standard lists of terms and conditions of the MWLWB, SLWB, GLWB and the WLWB. Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008

  8. Progress Step 2 Identify inconsistent and consistent terms and conditions of the LWB’s. Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008

  9. Progress Step 3 Collect or identify rationales for the creation of current terms and conditions from within the LWB’s or from external organizations, such as INAC. Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008

  10. Progress Step 4 Collect and review terms and conditions and the rationale for their development from other regulatory boards/organizations in other jurisdictions (ex. Progress INAC Inspectors Workshop- Dec 8-9, 2008 Enforceability of Terms and Conditions Administrative enforcement Communication policy between Inspectors and the Board Mandate- Wildlife vs. Habitat and Forestry Concerns Push other government agencies mandate back on the appropriate agency Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008

Progress INAC Inspectors Workshop- Dec 8-9, 2008 Management Plans Management plan- submitted to the Board for approval, but the plans can be delineated into jurisdictional mandates for enforcement- INAC, DFO, ENR etc. Plan approved by Board and Inspector?- examine the legal wording of bringing Inspector into the condition to allow for greater enforceability. Condition that links an approved management plan to a condition, which allows the enforceability by Inspectors. Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008

  14. Progress INAC Inspectors Workshop- Dec 8-9, 2008 Commitment from Inspectors for further quarterly meetings with Board staff to further cooperation and communication between the Boards and Inspectors. Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008

  15. Progress Step 6 Write summary paper on key issues, findings from previous steps, and provide recommendations. Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008

  16. Next Steps  Terms and conditions workshop with all stakeholders to discuss interim paper findings and recommendations (February, 2009). Revised standard conditions list. Update to the MVLWB- Working Group 4- Terms and Conditions –Yellowknife Dec 11, 2008
