The Statute “§ 5. Incestuous and void marriages” A marriage is incestuous and void whether the relatives are legitimate or illegitimate between either: • An ancestor and a descendant; • A brother and sister of either the whole or the half blood; • An uncle and niece or an aunt and nephew.
The Statute • Notice it does NOT state that cousins CAN marry. • What it does state is that in terms of familiar relations, what marriage are NOT allowed (i.e., prohibited). • The rest are allowed. • Since cousins are not prohibited under this statute, they are allowed.
