Description of Function • The Oil Pollution Act of 1990 amended the Clean Water Act and addressed the problems associated with preventing, responding to, and paying for oil pollution incidents in navigable waters of the United States. It created a prevention and compensation to deal with vessel- and facility-caused oil pollution to U.S. navigable waters. OPA increased federal oversight of oil transportation, while providing greater environmental safeguards by: • Enhancing federal response capability, • Broadening enforcement authority, • Increasing penalties, • Creating new research and development programs, • Increasing potential liabilities, and • Significantly broadening financial responsibility requirements
Regulation and Enforcement • The OPA is regulated by Environmental Protection Agency, or the EPA. • The OPA was created in response to the Exxon Valdezincident when eleven million gallons of oil into the Prince William Sound. Exxon Valdez oil spill
