    2. Common NAFTA Errors Filing a NAFTA claim when NAFTA C/O (Certificate of Origin) is not in your possession. The law states that a claim can only be made if the NAFTA C/O is in your possession at time of claim. If the C/O is not in the entry package and one is requested, failure to produce will result in denial of claim and a penalty under 19 USC 1592 for making a false claim. Filing a NAFTA claim when Country of Export is other then MX or CA. The law states that the imported mdse. must be exported from a participating NAFTA county (US, MX or CA) to qualify for NAFTA eligibility.
